ADMINISTRATIVE ORDER NO. 1997-03
Issued March 17, 1997
WHEREAS, a local emergency declaration has been issued on March 17, 1997 due to
the imminent threat of flooding caused by record snowpack levels and impending warm weather;
and,
WHEREAS, the City's local and interjtu-isdictiollal Disaster Emergency Plan and Program
is currently in effect; and,
WHEREAS, the Gallatin County Disaster Emergency Service Coordinator is also the City
of Bozeman's DES Coordinator; and,
WHEREAS, there are nwnerous Deaver darns and other debris located on the various
streams, ditches, and waterways located within the City of Bozeman and s>_u-1•ounding area; and,
WHEREAS, these beaver dams and other debris block the free flow of water and
exacerbate the potential for flooding thereby also causing an imminent tlueat of damage, injury,
or loss of life or property; and,
WHEREAS, the removal of the beaver dams and other debris is necessary to mitigate the
potential of flooding and to respond to and reduce potential injury and damage; and,
WHEREAS, the Acting City Manager, pursuant to M.C.A. § 10-3-40G, may direct or
compel disaster mitigation and response and recovery to an emergency or disaster area,
NOW, THEREFORE, pursuant to the emergency powers invested, I do hereby:
1. Authorize and direct the Disaster and Emergency Service Coordinator or his
designee to recruit and establish a list of civil defense volunteers willing to assist iu carlyillg out
disaster emergency functions and responsibilities.
2. •To remove ar cause the removal of Deaver dams and other debris from streams,
ditches and water courses when, in the judgment of the D)/S Coordinator, said beaver dams
constitute a danger to health, welfare, or safety of persons or property, or constitute an
impediment to the provisions of emergency services.

3. Tliat copies of this Adrninistrative Order be filed with the Clerk of the City
Conm~ission and the Montana Disaster and Emergency Services Division in Helena, Montana.
