INVITATION TO BID
Separate sealed bids for construction of College & Huffine Shared-Use Pathway will be
received by the City of Bozeman, Montana, City Clerk’s Office at City Hall, 121 N. Rouse,
until 2 P.M., local time, Tuesday, August 10, 2010, for construction of the project described
herein. All Bids that have been duly received will then be publicly opened and read aloud. Bids
shall be in a sealed envelope and addressed to the City Clerk, and entitled College & Huffine
Shared-Use Pathway.

The project consists of constructing a bicycle/pedestrian path with intersection improvements to
provide safe and efficient travel for non-motorized users. The work will construct new segments
of pathway, and remove existing sidewalks to construct wider paved paths to provide a link along
Huffine Lane and West College Street. The project also involves road approach and intersection
safety improvement for the pathway crossings. The project is along the south side of College
Street and the north side of Huffine Lane. It will begin on the south side of College Street near
the intersection of South 11th Avenue, and extend westerly to near the intersection of Huffine
Lane. On Huffine Lane, the project will continue with removing existing sidewalk and construct
a new 10-foot wide path east of Ferguson Avenue to connect to an existing path of the same
width. In addition, a short segment of path will be constructed on the east side of Fowler Avenue
from Huffine Lane to provide a connector route to the Bozeman Ponds. The work to be
performed generally consists of excavation, earthen embankment, concrete demolition and
disposal, placement of base gravel and bituminous surface, concrete ADA intersection/curb
ramps, signage, pavement markings, minor drainage, sprinkler irrigation relocation, revegetation,
and incidentals. The project is being funded by the City of Bozeman and the Community
Transportation Enhancement Program (CTEP).
All bids must be in accordance with the Contract Documents on file with the City Clerk of
Bozeman, City Hall, 121 N. Rouse Avenue, Bozeman, Montana, (406) 582-2321 and at the
offices of Robert Peccia & Associates, 825 Custer Avenue, Helena, Montana; (406) 447-5000.
Copies of the Contract Documents for use in preparing bids may be obtained from Robert Peccia
& Associates at the address stipulated above upon receipt of a non-refundable deposit of $75.00
for each set of documents including 11"x 17" drawings.
Work at the site is to commence within ten (10) days after the Notice to Proceed is issued.
Completion of the work is required within 45 consecutive calendar days after the Notice to
Proceed is given. The project includes liquidated damages that will be assessed as set forth in the
Special Provisions at $200.00 per calendar day, in addition to any damages required under the
Contractor Reimbursed Engineering Costs Section of the Supplementary Conditions, if the work
is not complete within the allotted contract time.
CONTRACTORS and any of the CONTRACTOR’S subcontractors doing work on this project
will be required to obtain registration with the Montana Department of Labor and Industry (DLI).
Forms for registration are available from the Department of Labor and Industry, P.O. Box 8011,
1805 Prospect, Helena, MT 59604-8011. Information on registration can be obtained by calling
(406) 444-7734. CONTRACTORS are not required to have registered with the DLI prior to
bidding on this project, but must have registered prior to execution of the construction
agreement. All laborers and mechanics employed by CONTRACTORS or subcontractors in
performance of the construction work shall be paid wages at rates according to the current
Federal Davis-Bacon Wage Rates. In accordance to City of Bozeman Commission Resolution
No 4250, each entity submitting a bid proposal affirms in writing it will not discriminate on the
basis of race, color, religion, creed, sex, age, marital status, national origin, or because of actual
or perceived sexual orientation, gender identity or disability and recognizing that the successful
bidder will enter into a contract which contains a provision prohibiting discrimination as
described above and this prohibition on discrimination shall apply to the hiring and treatment of
the CONTRACTOR’S employees and to all subcontracts. The CONTRACTOR shall be subject
to and comply with Title VI of the Civil Rights Act of 1964; Section 140, Title 2, United States
Code, and all regulations promulgated thereunder.
Each bid must be accompanied by a Certified Check, Cashier’s Check, or Bid Bond payable to
the City of Bozeman, in an amount not less than ten percent (10%) of the total amount of the
bid. Successful BIDDER(S) shall furnish an approved Performance Bond and a Labor and
Materials Payment Bond, each in the amount of one-hundred percent (100%) of the contract
amount within seven (7) calendar days after the Notice of Award is issued. Insurance as required
shall be provided by the successful BIDDER(S), and a certificate(s) of that insurance shall be
provided.
The City of Bozeman reserves the right to reject all proposals and bids received, to waive
informalities, to postpone the award of the contract for a period not to exceed sixty (60) days, and
to accept the lowest responsive and responsible bid that is in the best interest of the City of
Bozeman.
