Matt, The existing “alley” (access easement) exceeds the city’s alley standards as it exists today. No improvements are necessary to meet this condition. In particular I was looking at Condition of Approval 1e below: I was wondering what civil improvements you anticipate (if any) need to be done to bring the existing access easement landup to a city alley standard? Matt, I’m glad you were persistent on this. I was looking at the other easements because those were the easement numbers I was seeing referenced. This easements satisfies condition 1.b. I might be missing something, but Easement Document # 2505421 is a Public Street Easement. See this cut out from the attached easement. If clearly says it is “a perpetual street and utility easement:” granted to theCOB. If you look at the Exhibit A and B that are part of Easement Document # 2505421 – you can see it adds up to 30’. Matt, The access easement in place is “mutual access” agreement. There is no mention of the public’s ability to utilize this space. That is the difference between what is existing and what is being required in condition 1.b is the public’s right to utilize the space. I do not agree the existing easement satisfies condition 1.b. I believe the easiest way to achieve public access would be to grant a new easement on our standard easement template. Let me know if you want to discuss further. Susana / Karl, If you look at Easement Doc #2505421 (attached) you will see there is a total of 30’ for the access easement. There is 10’ west of the section line (Doc #2170763) and 20’ east of the section line for a total of 30’. Please let me know if you see itdifferently. Regards,Matt Matt E. Matt, as I understand it, to provide legal and physical access to the new Lot 2A2, BMC Section 38.400.090.B.2.c requires both the improved alley and the greenway or trail corridor with public access. Please have a chat with Karl Johnson as to the width of the public access easement on the unimproved lane from Baxter to the new Lot 2A2 per condition of approval 1. Band c. The easement shows a 20’ easement rather than the 30’ easement of Condition 1.b. Thanks. On page 9 of 26 – is what I assume will be the conditions of approval? If so, I am not sure whay b. needs to be a condition of approval. We have already determined that there is an existing 30’ public access easement there. See the first and second attachments. On #3 here – we addressed these items in the 2nd resubmittal to the COB. See the last attachment. We currently haveapproval for the infrastructure for the HOME 2 project (last attachment). So I am not sure why this would be a condition ofapproval??
