Matt, I cannot figure out what all that payment was intended to include. It seems to coincide with the timing of the Credit Union that partially occupies the site today, so I assume that payment was related to that. The total acres of this site is 1.52 + 5.53 = 7.05 acres The payment for 7.05 acres should be 7.05ac * 43560sq.ft./ac * $0.00214061 = $657.38 Since $371.40 has already been paid that leaves a remaining balance of $285.98. Karl, Not sure how Bob Murray calculated the Signal payback in the first attachment (see the email from Bob M to Keith Belden on 12/2//2006). But the second attachment is the actual check written by Phil Saccoccia – for $371.40 for Baxter and North 19th Signal Payback. Please let me know if this will work for condition #4 below. A couple things this still doesn’t answer though… I am not seeing this amount paid just as the calculated number. I cant figure out how this number was calculated. Non of the lot areas as the land is today or as the land was before the recent amended plat match that amount multiplied by this rate. Previous lots Lot 1 137,353 sq ft * $0.00214061 = $294.02Lot 2 134,075 sq ft * $0.00214061 = $287.14 New lots Lot1A 1.11 ac * 43560 ac/sqft * $0.00214061 = $103.50 Lot2A 5.12 ac * 43560 ac/sqft * $0.00214061 = $477.41 Let me know if I got anything wrong with my inputs here. Looks like this property paid into the Baxter and N. 19th Signal payback $371.40 back in 2006. I still did not find the actual payback agreement. Let me know what you see on your end. I am trying to find the payback agreement for the 19th and Baxter Intersection (like the Baxter Sewer agreement you sent in the email below) inour files. From what I remember (which is not much!) Phillip S. may have been the payee on the intersection project much like Tange’s Subdivision was in the sewer agreement you sent along. Does the city have the Payback Agreement for the South 19th and Baxter Lane Intersection improvements? We have the exhibit from the agreement – see attached. Matt, The city funded the construction and established the N 19th and Baxter Intersection Payback. I believe it was to construct the signal at the 19th and Baxter intersection, but I don’t have the traditional documentation we have for other paybacks involving reimbursing a private developer. You can view the boundary of this payback on our infrastructure viewer by turning on the “Payback Areas” layer. If you do this the hyperlink takes you to a different payback agreement but it does have the correct map for this payback at the end of the document. The rate is based on $0.00214061 per square foot of the lot and the history of payments is tracked on our servers. Let me know if you need anything else. Greetings Matt. I am concerned that prospective buyers read only the CC&Rs and not plat notes when they are doing their due diligence research and would “miss” your Condition No.1. Also, there are more easements that require shared maintenance than just the trail corridor. I have a feeling that you want to avoid the expense of having an attorney rewrite the CC&R document and I can understand that. Show me a revised condition of approval for the plat sheet that includes all the common areas that require shared maintenance responsibilities and I will see if that works for us. Thanks. I had a question on comment #29: Instead of modifying the covenants as stated in the comment above --- could we just expand note #1 on the Conditions of Approval page (see attachment) of the plat to deal with the maintenance of thelanguage you would like to see here?
