Dear Sirs: On February 15, 2022, the Bozeman City Commission granted approval of the above- referenced subdivision preliminary plat with conditions of approval and required Bozeman Municipal Code (BMC) provisions to be met with the final plat submittal. Pursuant to BMC Section 38.240.160.A, the preliminary plat approval for a single-phase major subdivision is valid for two years from the date of the Mayor’s signature on the Findings of Fact (FOF) document. Pursuant to BMC 38.240.160.A and Montana Code Annotated (MCA) Section 76-3-620, we attach the City Commission-adopted FOF document with this message. In a couple of weeks the document signed by the Mayor will appear in the City Clerk’s document file at the link noted below. The FOF identifies the regulations and statutes that are used in reaching the decision of conditional-approval of the Preliminary Plat (PP) and pages 10 through 20 describe the conditions of approval and BMC code provisions that must be met with the final plat application submittal. The staff evaluations in Section 6 identify the specific purposes of the conditions of approval. Please note Section 7.H on page 38 of the FOF document which identifies the appeal procedure for the Commission’s FOF decision. We look forward to working with you on the Final Plat application; please review the submittal requirements of BMC 38.220.070 and all conditions of approval and code provisions of the PP, particularly Code Provision No. 1 which advises you that unmet code provisions that are not specifically listed as conditions of approval do not in any way create a waiver or relaxation of the lawful requirements of the BMC.
