Dear Mr. Ralph: The above-referenced Master Site Plan Modification, application 22379, has received conditional approval. The conditions of approval for this modification are as follows: 1. BMC 38.410.060 - Easements: All Easements indicated below must be provided on city standard easements templates. Submit signed hard copy to Engineering prior to site plan approval. 2. BMC 38.220.080.A.i.4, 38.270.070.C.4, Special Improvement Districts (SIDs). The applicant must provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special Improvement Districts (SIDS) on City standard form for the following: a. Street improvements to N. 27th Avenue between E Valley Center Rd and Catron St including lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage; b. Street improvements to Catamount St between Davis Lane and E Valley Center Road including lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage; c. Street improvements to E Valley Center between Davis Lane and Catamount St including lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage; d. Intersection improvements at Catamount St and E Valley Center Road including lighting, signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage; e. Intersection improvements at Catamount St and N. 27th Ave including lighting, signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage; and f. Intersection improvements at N 27th Ave and Valley Center Rd including lighting, signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage. The SID template has been uploaded to the City Documents folder. The SID waiver document must be signed, notarized and recorded with the County Clerk and Recorder prior to final Master Site Plan approval. TDD: 406-582-2301 THE MOST LIVABLE PLACE. T Page 2 of 2 Planning As you are aware, you must comply with all provisions of Chapter 38 of the Bozeman Municipal Code that are applicable to this project, including but not limited to the following: Code Provisions ■ Per Section 38.100.080&38.200.110, the proposed project shall be completed as approved and described in this application. Any modifications to the submitted and approved application materials shall invalidate the project's legitimacy, unless the Applicant submits the proposed modifications for review and approval by the Department of Community Development prior to undertaking said modifications. The only exception to this law is repair. Future Impact Fees - Building permit applications require payment of transportation, water, sewer and fire impact fees according to the City of Bozeman adopted impact fee schedule in place at the time of building permit issuance. In addition, other fees such as Cash-in-lieu of Water Rights (CILW) or infrastructure payback district fees may be required prior to issuance of a Certificate of Occupancy for any building within the MSP.
