A departure is being requested for the following Bozeman Municipal Code section: 38.520.060.B.1.b, On-site residential and commercial open space Departure is requested per BMC 38.520.060.B.1.b: “Ground level private outdoor space. One hundred percent of the required open space may be provided by ground level outdoor space that is adjacent and directly accessible to the subject unit. Such open spaces must be enclosed by a fence and/or hedge at least 32 inches in height to qualify. Departures to this standard are permitted. “ The existing aesthetics of the surrounding neighborhood provide an open and walkable feel. Enclosing the open space would create a barrier out of character with the neighboring lots. The openness will encourage pedestrian travel and community recreation enhancing the experience for the intended users.
