MANDATORY REVEGETATION REQUIREMENTS: Areas disturbed during subdivision development (road construction, pond construction, service/utility/gas/electric/telephone line installation) shall have a layer of topsoil redistributed onto disturbed areas. Disturbed areas must be seeded to an appropriate grass seed mix for the site. During the first and second years of grass establishment, areas seeded to grass shall be mowed as appropriate to prevent weed seed development and dispersal. Name of gravel pit: Location: Contact person: *Be aware that gravel sources and topsoil may contain noxious weed seeds; therefore, we recommend using a source that is actively controlling noxious weeds on their property, consistent with an approved Weed Management Plan. 5 of 6 STATUS APPROVED NOT APPROVED RECOMMENDATIONS AND/OR CONDITIONS: Additional terms and conditions apply – see attached This Noxious Weed Management and Revegetation Plan (“Plan”) is a binding agreement between the Gallatin County Weed District (“District”) and the LANDOWNER. The Plan applies to the project and entire property identified above. The Plan is effective upon approval by the District Board (“Board”) for 3 years from the date of approval, or until the property’s ownership changes, or until a new Plan is entered. By entering this Plan, LANDOWNER agrees that the Board or its Representatives shall have the right to revise this Plan as necessary to effectuate the purposes of the Gallatin County Noxious Weed Management Plan or Montana County Weed Act. LANDOWNER agrees that the Board or its Representatives may inspect the property prior to granting approval of the Plan and, if approved, may perform such reasonable inspections as necessary to determine compliance with this Plan. By entering this Plan, LANDOWNER recognizes that noxious weeds exist on the property, and that failure to abide by the terms of this Plan is a violation of the Montana County Weed Act. LANDOWNER waives any statutory requirement for the District to inspect the land, and the District may enforce the violation upon giving 10 day notice to comply with the Plan. Prior to final plat approval of any phase of the subdivision, LANDOWNER shall comply with all requirements of the approved Plan. All areas of the property shall be, prior to final plat approval, sufficiently controlled for noxious weeds and sufficiently re-vegetated, as determined by the District. In addition, LANDOWNER shall provide documentation of annual weed control and all re-vegetation work as required by the District to demonstrate that the Plan has been sufficiently implemented (see page 6 for a list of required documentation). LANDOWNER recognizes that the approval of any requests for extensions or of final plats may be denied or delayed if noxious weeds have not been properly controlled. LANDOWNER agrees that this Plan is supported by good valid consideration and this Plan constitutes a binding contract and may be enforced as such. Weed Management Plan Proposed West University Project Bozeman, Gallatin County, Montana Property Description: The property, located at the corner of S 19th Street and West Kagy in Bozeman, MT, consists of approximately 95 acres of native grassland, hayed alfalfa and cultivated farmland. S. 19th Street runs the length of the property on the east side. West Stucky Road forms the south border. The west side of the property abuts agricultural property owned by Bart Farms and the north side abuts land owned by Montana State University. There are no ponds or lakes on the property. Two small streams bisect the length of the property from south to north. Two fenced parcels on the property of approximately 35 and 14 acres are currently cultivated with barley. A strip along the west boundary of the property of approximately 6.5 acres is currently part of an existing alfalfa field managed by Bart Farms. The balance of the property, approximately 40 acres, remains in two parcels of native grassland which are bisected by the streams and include wetland. Noxious Weeds Noted Canada thistle, musk thistle, and common tansy are the noxious weeds found on the property during the 8/28/22 site survey. The following areas are also color highlighted on the site map in this document. Common Tansy is present along the stream/ditch edges at the northeast corner of the property adjacent to the existing commercial office property. Due to the close proximity of the weeds to the stream, this area will require hand spraying. Musk thistle is found in the greatest concentrations in three locations: the northwest corner of the west grassland parcel and the north and east sides of the east grassland parcel. These areas, totaling 7 acres, have significant enough musk thistle to require broadcast spraying. There were a few scattered single musk thistle plants found in the balance of the grassland and these areas would be spot sprayed. Canada thistle is the most abundant noxious weed on the property. It is found along the lengths of all fence lines, Stucky and Kagy road margins, and along the length of the stream and wetland borders. These areas will all require hand spraying. Canada thistle is present in quantity on the south end of the east grassland and along the entirety of the west grassland west of the stream. These areas total 13.25 acres and will require broadcasting. Management Plan: Year 1 (Spring 2023) – The two interior cultivated fields will continue to be farmed by Gerry Dusenberry. The alfalfa field portion on the west side will continue to be hayed by Bart Farms. Approximately 20.25 acres, as described above, will require a broadcast application due to the level of infestation. The balance of the property, including fence lines, stream/wetland edges, grassland and along Kagy and Stucky, will be hand/spot sprayed. The application will be done using Corteva Chaparral at 3.3 ounces per acre, an Amine 2,4D at 1 Quart per acre, and Liberate non-ionic surfactant at 4 ounces per acre. A diluent rate of 20 gallons per acre is planned for adequate coverage. Timing will be between June 15st and June 30th to target the common tansy and musk thistle prior to bolting while giving the Canada thistle time to emerge. Year 2 (Spring 2024) The scope of the 2024 application will be very dependent on the state of development and will possibly be more extensive the Year 1 if dirt is disturbed and farming of the interior cultivated fields ends. We will schedule this year’s application between June 15th and June 30th for the most beneficial control of the variety of weeds present. The herbicide’s applied will be the same as for the first application except where disturbed soil is planned to be seeded. In those areas, an herbicide with no residual for seed germination control will be applied. The amount of soil disturbances, types of weeds present and progress of development will be determining factors in the magnitude and cost of the follow up applications as well as the herbicides selected. Year 3 (Spring 2025) A follow-up application will be planned in the spring of 2025. If the site is largely developed it is expected that spot spraying will be adequate to control any remaining weeds or new growth in disturbed areas. Again, this may vary greatly depending on the status of site development. Cost Year 1 is an actual contracted cost based upon the 2022 site survey. Year’s 2 and 3 are estimates and may vary due to the extent of site development, weather and seed spread from traffic and wildlife. Year 1 – Broadcast 20.25 acres @ $85/acre - $1721.25. Hand spray fence lines both sides, stream edges both sides, and wetland boundaries, Kagy and Stucky road margins. 4.5 hrs @ $145/Hr - $652.50. Total Year 1 - $2373.75 Year 2 – $ 2500.00 – (may vary greatly due to site development) Year 3 – $ 1800 – (may vary based on site status) 406 Weed Control LLC. is owned and operated by Mark Nichols. Mark Nichols is licensed for commercial weed control on rangeland and right away applications in the state of Montana – License number 105521-12. We are fully insured through First West Insurance of Bozeman, MT. Weed Control Program Service Agreement: 406 Weed Control LLC: Covenants and agrees with: West University LLC Barry Brown 109 E Oak Street, Ste 2B Bozeman, MT 59715 To perform the following services: Three year Weed Control Program at the proposed West University Project, Bozeman, Gallatin County, MT. The Year 1 Application will be completed with an initial application during the month of June, 2023. The initial Year One cost as contracted by 406 Weed Control LLC is $2373.75 and is based upon the property information provided by Stahly Engineering for the proposed project. Second & Third Applications will continue the following year (2024) and third year (2025) until completed per approved Weed Management Plan. Costs for Year’s Two and Three are estimates and the actual costs may vary based upon a number of variables such as the status of construction, number of disturbances, extent of the weed seed base on the property, precipitation levels, etc. The Client will be notified of any significant changes in the cost prior to application. Application Plan Cost: $2373.75 - Cost for Year One Application $2500.00 - Estimated Cost for Year 2 Application $1800.00 Estimated Cost for Year 3 Application Cancellation of this service agreement by the Client will result in a required notification to the Gallatin County Weed District. Terms: Payments are due upon completion of service. This agreement shall be binding on the parties and on their successors, legal representatives and assigns.
