Olive Street Bozeman, MT 59715 RE: CONCURRENT CONSTRUCTION REQUEST FOR 1825 KAGY STUDENT HOUSING SITE PLAN (CONR APP. #22313) TD&H ENGINEERING JOB NO. B22-025 Dear Suzy, The purpose of this letter is to formally request concurrent construction for the 1825 Kagy Student Housing site plan to allow for the construction of buildings to begin prior to the associated public infrastructure improvements being installed and accepted by the City. This request is being made pursuant to BMC 38.270.030 – Completion of Improvements. Specifically, we request that concurrent infrastructure and development construction be allowed to proceed under the provisions of subsections C.1.b and C.1.c for a single site plan development. The proposed public infrastructure improvements associated with this project include: • Replacement and re-routing of a portion of existing 6” water main with a new 8” water main that will be north of the new building footprint. • Relocation of existing Fire Hydrant #1051 approximately 6-feet to the south to be outside of the new fire lane alignment. • Relocation of existing Fire Hydrant #495 approximately 21-feet to the west to be outside of the new fire lane alignment. • Relocation of existing Sanitary Sewer Manhole #H0701 approximately 25-feet north along the sewer main line to be outside of the new building footprint and accessible from the new fire lane access aisle. The proposed utility relocations will be designed and constructed to City standards and will be wholly located within publicly dedicated right-of-way or public utility easements. New domestic water & sewer service lines for this project will be connected to the existing water & sewer mains existing on the property to serve the proposed development. Public water mains are already looped within streets and easements around the site. Fire protection services during building construction can be provided by existing fire hydrant #’s December 13, 2022 PAGE NO. 2 tdhengineering.com 495, 1051, 1110, 2065, and 3198 with only one fire hydrant being taken out of service at a time during the water main relocation activities associated with this project. The site can be readily accessed via S. 19th Avenue, W. Kagy Boulevard, and the privately maintained fire access drives on the north and east neighboring properties (please see the attached project map). Should the DRC initially approve concurrent construction as a purpose of this project, we will begin compiling the application set materials (Items 1-4) identified on the attached CCON Form for submittal. If a development is proposed on a site with existing infrastructure and requires public infrastructure extensions or upgrades on site or directly adjacent to the site an applicant may request to construct the public infrastructure and the building at the same time. This is called concurrent construction. Concurrent construction requires additional review and approval prior to building permit issuance and must be requested at the time of the initial planning entitlement such as a site plan or master site plan application. For off-site infrastructure and subdivision projects follow form CCOFF requirements and process. CONCURRENT CONSTRUCTION REQUIREMENTS CCON Water mains, sewer mains, stormwater system, and streets must meet all of the following requirements: 1. Any required on-site or directly adjacent extensions of water mains, sewer mains, stormwater system, or streets to be dedicated to the public: • Must be located entirely within publicly held easements or rights-of-way • Must serve only a single lot • Are the subject of an irrevocable offer of dedication to the city upon completion of the project • The development is under the control of a single developer who must retain control of the entire project until final completion • All work is under the supervision of a single general contractor • No subdivision of land is involved 2. The DRC must determine when the standards of this subsection BMC 38.270.030.C.1 are met • The fire department must consider whether adequate fire protection services are available from existing hydrants, and water supply exists to meet needs during construction 3. Approval of the final engineering design, including location and grade, for the infrastructure project must be obtained from the engineering department, and the Montana Department of Environmental Quality when applicable, prior to issuance of any building permit for the development 4. A certificate of occupancy must not be issued until all on-site and off-site water, sewer, stormwater, and street improvements necessary to serve the site are installed and accepted or approved as applicable by the city. The applicant understands and accepts the risk in application approval delays if the Concurrent Construction application does not satisfy all requirements of the BMC.
