L.L.C., of 1725 DeSales Street N.W., Suite 900, Washington, DC 20036, the GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of which is acknowledged, grant(s) to the CRY of Bozeman, with address of 411 East Main Street, Bozeman, Montana 59771, the GRANTEE, forever a public drainage easement in, through and across a strip of land situated in Gallatin County, Montana, to be located on the following described real property: Tract 1 of C.O.S. 1256 in NE4 of Section 2, T2S, RSE, City of Bozeman, Gallatin County The easement, an area 123.73' x 250.12' in size, shown by the shaded area and described as "DRAINAGE POND EASEMENT," is more particularly described on the attached Exhibit which by this reference is made a part hereof. The GRANTOR agrees that although the public drainage easement herein is granted to the City of Bozeman, as GRANTEE, the City of Bozeman has no responsibility or obligation to maintain the public drainage easement, or the above-described real property in, through and across which such easement is granted. The GRANTOR warrants that it is lawfully seized and possessed of the real property described above, and that it has a lawful right to convey the property, or any part of it. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The GRANTOR grants the above-described easement to the GRANTEE for the express purpose of a public drainage easement, and the GRANTOR grants the above-described easement only for so long as the above-described real property is used for public drainage purposes. If, at any time, the above-described real property is no longer needed for public drainage purposes, then the above-described easement expires and all title, rights and privileges herein granted reverts to the GRANTOR, its successors and assigns. The terms, covenants and provisions of this easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto. -- DATED this IU day of October,2005.
