I,the undersigned Owner oftherealpropertysituatedin the County of Gallatin,Stateof Montana, and more particularlydescribed as follows:Lot R1, NORTON EAST RANCH SUBDIVISION, PHASE 3A, [PlatJ-564],locatedintheNorth HalfofSection9,T.2 S.,R. 5 E. of P.M.M., Cityof Bozeman, GallatinCounty, Montana. IN CONSIDERATION of receivingfinalplatapproval from the City of Bozeman forthe Norton East Ranch Subdivision Phase 6 Final Plat,along with accompanying rights and privilegesand forothervaluableconsideration,thereceiptofwhich ishereby acknowledged, and in recognition of the impacts to City transportationand infrastructuresystems thatwillbe generatedby the development of the above-described property,do hereby for ourselves,our heirs,personalrepresentatives,successorsand assigns,waive the righttoprotestthecreationof one ormore SpecialImprovement Districts(SID's)forthe following: a. Streetimprovements to Cottonwood Road including paving, curb/gutter,sidewalk,and storm drainage; b. Streetimprovements to Laurel Parkway including paving, curb/gutter, sidewalk,and storm drainage; c. Streetimprovements to West Babcock including paving, curb/gutter, sidewalk,and storm drainage; d. Streetimprovements to Durston Road including paving, curb/gutter, sidewalk,and storm drainage; e. Streetimprovements to Gooch HillRoad includingpaving, curb/gutter, sidewalk,and storm drainage; f. Intersectionimprovements to Laurel Parkway and Durston; g. Intersectionimprovements to Laurel Parkway and West Babcock Street; h. Intersectionimprovements toLaurelParkway and Huffine Lane; i. Intersectionimprovements to Cottonwood Road and Huffine Lane; and j. Intersectionimprovements to Cottonwood Road and West Babcock Street. Or tomake any writtenprotestagainstthe proposed work or againsttheextentorcreationofthe districts(SID's)to be assessedinresponse toa dulypassed resolutionofintentiontocreateone 03/03/23 22203 Norton East Ranch Ph. 5B FP or more specialimprovement districtswhich would includethe above-describedproperty. In the event an SID isnot utilizedfor the completion of these improvements, the developer agrees to participatein an alternatefinancing method forthe completion of said improvements on a fairshare,proportionatebasisasdetermined by square footage of property, taxable valuationof the property,trafficcontributionfrom the development or a combination thereof. This waiver shallbe a covenant running with the land and shallnot expire with the dissolutionofthe Property Owners Association,provided however thiswaiver shallapply tothe lands hereindescribed.
