Griffin and Brian, Please see above which I believe was lost in the email chain. I believe this response by Kevin confirms he is using water credits for Norton Phase 5A and 5B. Kevin - will you please confirm to Griffin by responding to this email that it is your intent to use water rights credits as opposed to cash-in- lieu for this project On Thu, Aug 4, 2022 at 3:27 PM Griffin Nielsen <GNielsen@bozeman.net> wrote: Greg/Kevin,    4 Our records indicate that there is an available credit of 70.885AF from  the 41‐H30103245 Change Authorization, attached is the tracking spreadsheet. Can you elaborate on the calculus beyond the 69AF and/or let me know if there is a discrepancy in the tracking sheet?    For the 98 single‐family units the credit required will be 22.932AF bringing the balance to 47.953AF (70.885‐ 22.932AF) however, there is still the irrigation demand to be considered. Glancing at the irrigation plan it appears that irrigation will be supplied by the domestic system. Is the intention to use the credit for the irrigation demand as well?    Thanks,    City of Bozeman MT Griffin Nielsen, PE| Engineering Department D:406.582.2279 C:406.595.1598 gnielsen@bozeman.net           From: Greg Stratton <greg@kildaystratton.com> Sent: Thursday, August 4, 2022 11:26 AM To: Brian Heaston <bheaston@BOZEMAN.NET>; Griffin Nielsen <GNielsen@BOZEMAN.NET> Cc: Kevin Spencer <kspencer@ksstone.com> Subject: Cash‐in CAUTION: This email originated from  outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe. Griffin, 5 This is to confirm that Norton Ranch Properties will use existing water rights credits to meet the water demand for Norton Ranch Phase 5A and Phase 5B. Phase 5A proposes 51 Single Family Units. Phase 5B proposes 47 Single Family Units. Based on our calculations Norton Ranch Properties maintains approximately 69 acre-feet worth of water rights credits. Based on the City’s acre-feet to water credit conversion for single family use, one (1) SFC = 0.234 acre-feet, the additional 98 WRCs result in 23 acre-feet. The owner would like to dedicate this 23 acre-feet from his water right credit balance to this project. Therefore, no additional CIL payments are required. Kevin – Can you please confirm that this is your intent? Griffin - Will you please confirm the remaining water right credit balance following your review and calculation. -- Greg Stratton Partner 2880 Technology Blvd West Suite 273 Bozeman, MT 59718 406-599-5603 greg@kildaystratton.com www.kildaystratton.com City of Bozeman emails are subject to the Right to Know provisions of Montana’s Constitution (Art. II, Sect. 9) and may be considered a “public record” pursuant to Title 2, Chpt. 6, Montana Code Annotated. As such, this email, its sender and receiver, and the contents may be available for public disclosure and will be retained 6 pursuant to the City’s record retention policies. Emails that contain confidential information such as information related to individual privacy may be protected from  disclosure under law. -- Greg Stratton Partner 2880 Technology Blvd West Suite 273 Bozeman, MT 59718 406-599-5603 greg@kildaystratton.com www.kildaystratton.com ‐‐ Greg Stratton Partner 2880 Technology Blvd West Suite 273 Bozeman, MT 59718 406-599-5603 7 greg@kildaystratton.com www.kildaystratton.com City of Bozeman emails are subject to the Right to Know provisions of Montana’s Constitution (Art. II, Sect. 9) and may be considered a “public record” pursuant to Title 2, Chpt. 6, Montana Code Annotated. As such, this email, its sender and receiver, and the contents may be available for public disclosure and will be retained pursuant to the City’s record retention policies. Emails that contain confidential information such as information related to individual privacy may be protected from  disclosure under law. ‐‐ Greg Stratton Partner To help protect your privacy, Microsoft Office prevented automatic download of this picture from the Internet. 2880 Technology Blvd West Suite 273 Bozeman, MT 59718 406-599-5603 greg@kildaystratton.com www.kildaystratton.com
