The Middle Creek Ditch Company has met with Parker Langeand Lee Hageman
onsite at South 40 Subdivision and are actively coordinating on the project.
The Middle Creek Ditch Company will only give final approval after reviewing the
final design for South 40 Subdivision.

FOURTH AMENDMENT TO BYLAWS OF THE MIDDLE CREEK DITCH COMPANY
This Fourth Amendment to the Bylaws of The Middle Creek Ditch Company is made effective as
of June !v6', 2022 and is amended to include a new provision the Board of Directors voted to
adopt as follows:
ARTICLE XVI
(Encroachment Permits; Consulting Fees)
16.1 Encroachment Permits will be issued for a fee of $200 per linear foot for any canal
crossings, including, but not limited to, bridges, culverts and underground utilities.
Encroachment Permits will automatically be required for any encroachment projects
involving the Middle Creek Ditch and Middle Creek Ditch laterals.
16.2 The company will charge a consulting fee of$1,000 per development to start the process
for a meeting or site visit concerning any ditch on the Middle Creek Ditch system. Any
professional fees incurred by The Middle Creek Ditch Company, such as legal and/or
engineering will be in addition to the$1,000 consulting fee referenced above.
Both the Encroachment Permits and Consulting Fees will be required before any contracts are
signed allowing construction to proceed.
