HomeMy WebLinkAbout023 - Appendix T - Conservation District Ditermination a. Board opinion is that affordable housing is good! From CD standpoint- agricultural and water rights/water availability concerns. Question on if water rights were transferred? Draft a letter mentioning GCD’s opinions on the development. Mention 310 law. Dry Creek/perennial stream runs through there and (potentially) Mammoth Ditch. Would like to see some more trees/landscaping incorporated. January 12, 2023 Christine Pearcy c/o Morrison-Maierle 2880 Technology Blvd. W. Bozeman, MT 59718 Dear Christine: The Gallatin Conservation District 310 inspection team met with you on Wednesday, December 7, 2022 to determine jurisdiction of a project located near the intersection of 19th and Graf in Bozeman, MT. The Gallatin County GIS page labeled the water feature as a ditch and not needing a 310, but historic plats label the water as Mandeville Creek. This area has been extensively studied by resource professionals and has been designated as a stream/ditch. As such, Gallatin Conservation District has jurisdiction over the waterway and a 310 permit for projects impacting the bed and/or banks is required. Please let me know if I can be of further assistance.
