The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. Thank you, comment noted. 2. BMC 38.270/030 (C) Completion of Improvements – the applicant has requested concurrent construction for the public infrastructure with the development. a. The applicant is advised that Plan and Specification approval is required from the City and State (prior to issuance of a building permit). Concurrent construction plan and narrative are provided with this submittal for review and approval prior to building permit issuance. b. Please provide a hard copy of the executed original conditional irrevocable offer of dedication to be submitted to City commission consent. An irrevocable offer of dedication was approved and submitted with the infrastructure plans that have already been approved.
