Philip, Based on the comments from Engineering within the project application in ProjectDox, it appears as though Engineering comments were not addressed with the most recent submittal. The applicant (Matt) has been sent a revise and resubmit task. Matt should be able to share with you any of the outstanding engineering comments. Matt,Thank you for your patience on this response. Susana had sent your easement drafts to Karl in Engineering to ensure the language wouldwork and he has provided the following comment. The easement is acceptable to satisfy the comment. The reason we thought we needed another one was that it was labeled as mutual accesswhich wouldn’t provide public access but this one does so we are good. Susana, Just got the email “Respond and Resubmit Task Assignment for 21430 Saccocia SUB of 407C PP”. I got into ProjectDox and was looking at the Planning Comments. In particular this comment: “From the southern point of Baxter Lane southward into the "mutual access easement" we need a perpetual public vehicular and pedestrian access easement to a minimum of 25-feet length of the new Lot 2A2 frontage to satisfy BMC 38.400.090.B.2 legal and physical access to every lot. Then, there must be a trail corridor connecting this access pointeastward through Lot 2A2 and 2A1 to Sacco Drive.” I am not sure I understand what you are asking for here. There are two existing Public Access and Utility Easements in this area. See the attached Easement Doc # 2505421. From this document you can see there is 30’ of Public Access and UtilityEasement already in place here. Are you looking for something outside of this to meet the comment above? I have made the changes to Sheet 2 – please let me know if this is whatyou are looking for? I also added the note that the POA must be responsible for the maintenance of the trail corridor on theConditions of Approval page (Sheet 3). This is where we have been recording similar maintenance responsibilities of the POA’son various COB plats (see text block below for detail). Greetings Matt. This application will be discussed at our Development Review Committee next week on 12/15 and we will give your our formal comments via Project Dox on the 16th. However, I want to give you a heads up before then that we will need a revised Sheet 2 that properly shows and labels the trail corridoracross both lots to meet the Code’s legal and physical access requirement. The attached sheet shows the alignment we need to see on the platand the proper label and note. The trail corridor would be a public access easement in the form of a shared use path which must be 10’feetwide within the 25-feet perpetual public access easement. Engineering and Parks Departments will comment on the surface treatment forthis trail. We will need the two lot owners to enter into an agreement to maintain the trail in perpetuity, including snow removal. This couldbe via a property owners association or some other mutual agreement. This agreement must be recorded prior to final plat approval.We cannot accept any revised Sheet 2 until the complete revised submittal is sent to ProjectDox; I just want to give you a heads up on thisissue. Without a proper trail satisfying the 38.400.090.B.2 access requirement, we cannot approve this plat. Give me a call if you have questions. Thank you and have a great day.
