IF REQUESTED BY THE INSPECTOR, THECONTRACTOR SHALL PROVIDE PROOF OF A PERMIT FROM SAID DIVISION.3.THE CONTRACTOR'S OPERATIONS SHALL BE CONFINED WITHIN THE PROJECT LIMITS. MATERIALS AND EQUIPMENT SHALL BE STORED ON THE PROJECT SITE WHEREAPPROVED BY THE OWNER. IT SHALL BE UNDERSTOOD THAT THE RESPONSIBILITY FOR PROTECTION AND SAFEKEEPING OF EQUIPMENT AND MATERIALS ON OR NEAR THESITE WILL BE ENTIRELY THAT OF THE CONTRACTOR AND THAT NO CLAIM SHALL BE MADE AGAINST THE OWNER BY REASON OF ANY ACT OF AN EMPLOYEE OR TRESPASSER.4.THE CONTRACTOR SHALL NOTIFY THE ENGINEER AND THE CITY, COUNTY, AND/OR STATE INSPECTOR 48 HOURS PRIOR TO COMMENCING CONSTRUCTION AND 24 HOURS INADVANCE OF SPECIFIC INSPECTION NEEDS DURING THE COURSE OF THE WORK. ALL WORK SHALL BE PERFORMED DURING NORMAL WORKING HOURS AND SUBJECT TO THEAVAILABILITY OF AN INSPECTOR AND APPROVED BY THE ENGINEER. THE CONTRACTOR WILL BE BILLED FOR SAID INSPECTION SERVICES AS PROVIDED IN THE MOSTRECENTLY ADOPTED FEES FOR SUCH SERVICES.5.THE CONTRACTOR SHALL PERFORM ALL CONSTRUCTION ACTIVITIES IN A MANNER TO MINIMIZE INCONVENIENCE TO THE ADJACENT BUSINESSES.6.THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROTECTING ALL PUBLIC AND PRIVATE PROPERTY INSOFAR AS IT MAY BE AFFECTED BY THESE OPERATIONS, ALL COSTSFOR PROTECTING, REMOVING, AND RESTORING EXISTING IMPROVEMENTS SHALL BE BORNE SOLELY BY THE CONTRACTOR.7.THE CONTRACTOR SHALL AT ALL TIMES TAKE WHATEVER MEASURES ARE NECESSARY TO ASSURE THE PROPER CONTAINMENT AND DISPOSAL OF POLLUTANTS ON THE SITEIN ACCORDANCE WITH ANY AND ALL APPLICABLE LOCAL, STATE, AND FEDERAL REGULATIONS.8.THE CONTRACTOR SHALL IMMEDIATELY CLEAN UP ANY CONSTRUCTION MATERIALS INADVERTENTLY DEPOSITED ON EXISTING STREETS, SIDEWALKS, OR OTHER PUBLICRIGHTS-OF-WAY AND MAKE SURE STREETS AND WALKWAYS ARE CLEANED AT THE END OF EACH WORKING DAY.9.CONSTRUCTION WORK ZONE TRAFFIC SIGNS SHALL BE FURNISHED, INSTALLED, AND MAINTAINED IN ACCORDANCE WITH APPLICABLE REQUIREMENTS OF THE REGULATORYAGENCIES HAVING JURISDICTION. A TRAFFIC CONTROL PLAN, PREPARED BY THE CONTRACTOR, MAY BE REQUIRED BY THE CITY OR STATE. "CONSTRUCTION AHEAD"WARNING SIGNS ARE TO TO BE INSTALLED ALONG ADJACENT ROADS OR DRIVEWAYS. FLASHERS WITH CAUTION TAPE ARE TO BE INSTALLED WHERE ANY CONSTRUCTIONACTIVITY CROSSES A SIDEWALK OR PEDESTRIAN PATH IN ACCORDANCE WITH THE SPECIFICATIONS AND ANY OR ALL LOCAL REGULATIONS.10.NO STOPPING, PARKING, OR STORING OF CONSTRUCTION MATERIALS IN THE PUBLIC STREETS /ROADS, RIGHTS-OF-WAY, OR ANY DRIVEWAY IS ALLOWED.11.CONTRACTOR IS RESPONSIBLE FOR VERIFYING THAT THERE IS A CONSTRUCTION PERMIT APPROVED BY THE MONTANA DEPARTMENT OF ENVIRONMENTAL QUALITY (MDEQ)OR LOCAL GOVERNING AGENCY AS APPROPRIATE FOR THE CONTROL OF STORM WATER RUNOFF.
