It should be noted that buffers are not required for wetland feature. 2. Table of impacts are included. Only one wetland feature (isolated, and federally non- jurisdictional) is being impacted. This impact will be mitigated via on-site wetland creation. Mitigation is not required by the US Army Corps of Engineers. The City of Bozeman is requiring the mitigation. 3.List of Indirect Impacts: all indirect impacts will be mitigated. 4.Source, type and method of fill (information attached). 5.Avoidance and Minimization – approach detailed and preliminarily approved by the City of Bozeman. 6. Impacts to hydroperiod – details on groundwater elevation trends included. 7. Indirect Impacts List of Indirect Impacts Indirect impacts Indirect impacts are caused by the action, but that are later in time or farther removed in distance but are still reasonably foreseeable. • Loss of a recharge area • Change in local drainage pattern These indirect impacts will be mitigated in the following ways: • Recharge area will be replaced in the parkland/openspace • Drainage for the proposed project is engineered and will be reviewed and approved by the City of Bozeman. It is anticipated that a majority of the runoff from site development will be directed towards underground retention and detention systems which will increase recharge to the groundwater. 4. Fill Information Source, method, and type of fill The source of the fill will be locally sourced from soil stockpiles from neighborhood construction activities. The method of fill will be engineered grading work. The material will be placed in accordance with the Montana Public Works Standard Specifications as a Type C Backfill in order to assure that the material does not settle significantly after placement but also is not compacted to a point where it would interfere with groundwater migration or plant growth. 5. Avoidance and Minimization Avoidance and Minimization Development alternatives included designs which would result in 1) not developing the site, and 2) developing the site, impacting on-site wetlands, and mitigating for wetland impacts on-site near a deed- protected wetland, and taking advantage of relatively high groundwater conditions. On-site mitigation near the deed protected wetlands would expand an in-tact, high-quality aquatic ecosystem instead of preserving a disconnected, isolated wetland in a highly developed urban setting. Following the analysis of these alternatives by Project engineers and scientists, it was determined that permanently impacting the entirety of Wetland 3 was determined to be the preferred alternative based on the development objectives for the site and the functional benefits to wetlands in a deed restricted area near Baxter Creek. On February 18, 2022, the West Park Subdivision team received an email from Tyler Steinway with Intrinsic Architecture. This email stated the following: “Brian Heaston (COB Engineer) did a quick review of the conceptual wetlands plan and denoted that the proposal was good in his opinion and would encourage staff support of the concept. The improvement of the wetlands around the southeast portion of the subject property would produce a net gain in wetlands which has a much higher wetland value than that being destroyed with the subdivision.” 6. Impacts to Hydroperiod Impacts to Hydroperiod Natural hydroperiods of wetlands vary spatially and temporally with flood and drought cycles altering. A limited geo-investigation was performed on the subject property in March/April 2020 to determine the depth to gravel across the site. A total of 23 test holes were drilled at this time, and seven of the test holes have been used as groundwater monitoring locations since March 24, 2021. The depth to groundwater tables and graphs for March 24, 2021 to March 30, 2022 are provided in Attachment 1. A map of groundwater monitoring locations is provided as Attachment 2. Across the seven monitoring wells, the depth to groundwater was generally at its shallowest in late May and ranged from 0.33 feet to 2.64 feet below ground surface. Groundwater was generally at its deepest level in late September/early October with groundwater levels between 1.69 feet and 3.54 feet below ground surface. With limited data provided for the subject property, it appears groundwater levels fluctuate at or less than approximately two feet throughout the calendar year. It is assumed that the land used for mitigation will undergo a change in hydroperiod due to the grading plans and access to the water table. This change is reflected in Drawing D-2 (attached). Cumulative Adverse Effect from Past Activities Public Interest Cumulative adverse effects of past activities on the wetland and the uniqueness and scarcity of the wetland Cumulative adverse effects of past activities on the wetland include: • Noxious weed invasion. • Encroachment of trails and roadways • Encroachment of housing and development These impacts will be mitigated by actively managing noxious weeds within the wetland creation area. The property is now under an active weed management plan with Gallatin County. The wetland will be mitigated on-site near other deed protected wetland areas, creating a more continuous, robust wetland/riparian community associated with Baxter Creek. After evaluation using the MDT Wetland Assessment Method (attached), Wetland 3 was rated as Category IV wetland for having a “low” rating on the uniqueness. 10.Mitigation/Assessment to Changes in Hydroperiod 38.220.130 3.a.3 and 38.610.090 Natural hydroperiods of wetlands vary spatially and temporally with flood and drought cycles altering. A limited geo-investigation was performed on the subject property in March/April 2020 to determine the depth to gravel across the site. A total of 23 test holes were drilled at this time, and seven of the test holes have been used as groundwater monitoring locations since March 24, 2021. The depth to groundwater tables and graphs for March 24, 2021 to March 30, 2022 are provided in Attachment 1. A map of groundwater monitoring locations is provided as Attachment 2. Across the seven monitoring wells, the depth to groundwater was generally at its shallowest in late May and ranged from 0.33 feet to 2.64 feet below ground surface. Groundwater was generally at its deepest level in late September/early October with groundwater levels between 1.69 feet and 3.54 feet below ground surface. With limited data provided for the subject property, it appears groundwater levels fluctuate at or less than approximately two feet throughout the calendar year. It is assumed that the land used for mitigation will undergo a change in hydroperiod due to the grading plans and access to the water table. This change is reflected in Drawing D-2 (attached). Development alternatives included designs which would result in 1) not developing the site, and 2) developing the site, impacting on-site wetlands, and mitigating for wetland impacts on-site near a deed- protected wetland, and taking advantage of relatively high groundwater conditions. On-site mitigation near the deed protected wetlands would expand an in-tact, high-quality aquatic ecosystem instead of preserving a disconnected, isolated wetland in a highly developed urban setting. Following the analysis of these alternatives by Project engineers and scientists, it was determined that permanently impacting the entirety of Wetland 3 was determined to be the preferred alternative based on the development objectives for the site and the functional benefits to wetlands in a deed restricted area near Baxter Creek.
