"""**nis!°° IlllllllOlllllll|llllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllllll SEWER AND WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT Swissdetail Inc.,of 3004 N.27th Avenue,Bozeman,MT 59718,the GRANTOR,in considerationof $1.00 and other good and valuable consideration,receiptof which ishereby acknowledged,grant(s)to theCity of Bozeman,a municipal corporationof theStateof Montana, with officesat 121 North Rouse Avenue,Bozeman,Montana 59715,GRANTEE,itssuccessors and assigns,a perpetualeasement to lay,constructand maintain sanitarysewer pipelinesand water mains with the usual services,valves,connections,accessoriesand appurtenances forthe purpose of transmittingsanitarysewer and water in,through and acrossa stripof land situatedin GallatinCounty,Montana,30 feetwide tobe locatedon the followingdescribedrealproperty: Lot 3,Block 4,CattailCreek Subdivision Phase 1,[PlatJ-340],located in the Northwest Quarter of Section 35,Township 1 South,Range 5 East of P.M.M.,GallatinCounty, Montana. The easement ismore particularlyshown and dimensioned on the attached Exhibit A which by thisreferenceismade a partof thisdocument. This grantincludesthe rightof the GRANTEE,itssuccessors,permittees,licensees,and assigns and itsand theiragents and employees,to enterat alltimes upon the above-described land by using existingroads or trailsor otherwise by a route causing the leastdamage and inconvenience to the GRANTOR in order to survey and establishthe route and locationof the easement and the pipelineand to: (1)Construct,operate,patrol,repair,substitute,remove,enlarge,replace,and maintain the pipeline,services,connections,accessoriesand appurtenances; (2)Trim,remove,destroy,or otherwise controlany treesand brush insideor outside the boundaries of the easement which may,in the opinion of the GRANTEE,interfereor threatento interferewith or be hazardous to the construction,operationand maintenance of the pipeline; (3)Grade the land subjectto thiseasement and extend the cuts and fillsof thisgrading into and on the land adjacentto thatwhich issubjecttothiseasement tothe extentGRANTEE may findreasonablynecessary;and (4)Support the pipelineacross ravinesand water courses with structureswhich GRANTEE deems necessary. THE GRANTEE AGREES: (1)That,in connection with the construction,operating,patrolling,repairing,substituting, removing,enlarging,replacing,and maintaining of said sanitarysewer pipelinesand water mains,itwill repairor replace,at itssole expense,or pay to GRANTOR(S)the reasonable value of any damages to growing crops,existingfences,ditchesand other appurtenances of saidland thatmay be disturbedby itsoperation. (2)That,during operationsinvolvingexcavation,itwillremove thetopsoilfrom the trenched area to a depth of one foot,or to the fulldepth of the topsoil,whichever is less,and stockpilesaidtop soilforreplacement over the trench.Itwillremove from the siteany largerocks or surplusexcavating materialor any debristhatmay have been exposed by theexcavationand remains afterbackfillingiscompleted.And,itwillleavethe Snished surfaceinsubstantiallythe same conditionas existedpriorto the beginning of operations except thatthe surfaceof backfilledareas may be mounded sufficientlyto prevent the formationof depressionsafterfmal settlementhas taken place. THE GRANTOR(S)AGREES: (1)At no time willthey build,construct,erector maintainany permanent structurewithin the boundariesof saideasement withoutthepriorwrittenconsentof GRANTEE. (2)At no time willthey modify the fmished grade of the land over the pipelineby removal of existingsoilor by placement of fillmaterial within the boundaries of said easement withoutthepriorwrittenconsent of theGRANTEE. (3)That where the subjectimprovements are not locatedunder improved public or private streetsor other provided access,a 12 foot wide all-weather access road may be constructedwithin the easement where at the City'sdiscretionsuch accessisrequiredfor operationand maintenance purposes. (4)The GRANTOR(S)warrants that they are lawfully seized and possessed of the real property described above,that they have a lawful rightto convey an easement on the property,or any part of it,and thatthey will foreverdefend the titleto this property againsttheclaims of allpersons. (5)The GRANTEE may peaceably hold and enjoy the rightsand privilegesherein granted without any interruptionby the GRANTOR(S).The terms,covenants and provisionsof thiseasement and agreement shallextend to and be binding upon the heirs,executors, administrators,personalrepresentatives,successorsand assignsof thepartieshereto.
