HomeMy WebLinkAboutCharter - Will Serve Letter August 15, 2022 Attn: Mike Badner 387 Gallatin Park Drive, Suite 102 Bozeman, MT 59715 RE: Northwest Crossing – Phase 2 Dear Terri, Your new single family housing project Northwest Crossing – Phase 2, located at Baxter Lane and Cottonwood Road, Bozeman, MT 59718 is in Charter Communication’s footprint for video, internet and voice services. Absent of any unforeseeable adverse circumstances or conditions including any force majeure events outside of Charter’s control, and upon completion of a mutually agreed upon Service Agreement, Charter Communications will be able to extend its plant to provide service to your project. We will need to work with your representatives on an Access Agreement, for your project. We will need this Agreement executed prior to Charter beginning our construction phase for the project. Not a Binding Obligation. THIS LETTER OF INTENT DOES NOT CONSTITUTE OR CREATE, AND SHALL NOT BE DEEMED TO CONSTITUTE OR CREATE, ANY LEGALLY BINDING OR ENFORCEABLE OBLIGATION ON THE PART OF EITHER PARTY TO THIS LETTER OF INTENT. NO SUCH OBLIGATION SHALL BE CREATED, EXCEPT BY THE EXECUTION AND DELIVERY OF THE ACCESS AGREEMENT CONTAINING SUCH TERMS AND CONDITIONS OF THE PROPOSED TRANSACTIONS AS SHALL BE AGREED UPON BY THE PARTIES, AND THEN ONLY IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF SUCH ACCESS AGREEMENT. One of the plan check comments was to get a will serve letter from Charter and Century Link. Attached is our draft site plan showing the overall plan type and lotting concepts.
