RE: Stormwater Pollution Prevention Plan Review Notice: West Side Flats

The City of Bozeman (City) has reviewed the Notice of Intent (NOI) and Stormwater
Pollution Prevention Plan (SWPPP) for the West Side Flats (Project). The Project’s
documents contain multiple instances of noncompliance with the Bozeman Municipal
Code (BMC) and Montana Department of Environmental Quality (MDEQ) General
Permit for Stormwater Discharge Associated with Construction Activity (General
Permit). See the attached SWPPP Review Checklist.
The City does not require you to resubmit your NOI and SWPPP with corrections before starting construction; however, the noncompliant items are subject to review
upon Project inspection by City Enforcement Agents. Additionally, the City, MDEQ,
and United States Environmental Protection Agency all enforce regulations contained within the General Permit. To avoid noncompliance with all agencies, please complete
the following:
1. Update noncompliant areas within the NOI and SWPPP before starting construction.
2. Install and/or implement erosion, sediment, and pollutant control best
management practices before the start of ground-disturbing activities. 3. Install and maintain all best management practices per their specifications.
4. Continuously remove sediment and debris impacting the City’s infrastructure.
5. Stabilize disturbed areas immediately that will remain inactive for 14 or more days.
The City will hold you solely responsible for any instances of non-compliance of the
BMC and General Permit. Enforcement actions may include Stop Work Orders, Civil
Penalties, and Criminal Charges. Please contact the City if you have any questions or
require compliance assistance during this project.
