HomeMy WebLinkAbout22010 Approval Letter October 3, 2022 – Transmitted via Project Dox Only Shay Myers Solstice Design Build LLC PO Box 712385 Salt Lake City, UT 84171 RE: Lofts on Beall Street Site Plan and Conditional Use Permit, Application 22010 Dear Applicant, The Site Plan for the above-referenced project has received conditional site plan approval as the City Commission provided a favorable motion for the Conditional Use Permit and the Site Plan (listed below). Once all Conditions of Approval and Code Requirements listed in the staff report dated September 9, 2022 are met a final plans approval will be issued and the plans will be batch stamped as approved. The City Commission, as the review authority held a public hearing on September 20, 2022 and made a favorable motion for the Conditional Use Permit and Site Plan approval. Conditional Use Permit: “Having reviewed and considered the application materials, public comment, and all the information presented, I hereby adopt the findings presented in the staff report for application 22010 and move to approve the Lofts on Beall Street Conditional Use Permit subject to conditions and all applicable code provisions.” Site Plan: “Having reviewed and considered the application materials, public comment, and all the information presented, I hereby adopt the findings presented in the staff report for application 22010 and move to approve the Lofts on Beall Street Site Plan subject to conditions and all applicable code provisions.” As the applicant, you must comply with all provisions of the Bozeman Municipal Code, which are applicable to this project. All unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. Future Impact Fees - Building permit applications will require payment of the required transportation, water, sewer and fire impact fees according to the City of Bozeman adopted impact fee schedule in place at the time of building permit issuance. If you desire an estimate of the required impact fees according to current rates please contact the Department of Community Development. Please be informed that ANY changes from the final plan or final building elevations will need to be reviewed by the Department of Community Development. This City Commission project decision may be appealed by filing a notice of appeal in the Eighteenth District Court of Gallatin County, within thirty days after the filing of the decision, by following the procedures of MCA 76-2-327.
