Good morning all, As the property owner, I just wanted to reach out and hopefully get some direction on this ROW issue so we can finish up the full city site plan submittal and hopefully still be able to start construction this spring/early summer. I completely understand that delays are expected, but we have been at a standstill for 5 weeks as we have waited direction on this single issue. Please advise so we can continue moving forward as efficiently as possible. I want to touch base with Taylor. My biggest issues is the other properties should have dedicated 50 feet vs the 45 feet. I want to confirm with Taylor that we are ok with the 45 for the future road cross section. Sorry, we are trying to fit this in with all of the other reviews in the queue. Hi Ross, Do you know whether Chris Saunders has had a chance to review the information regarding the additional 5' of ROW requirement at Nahorniak Commons on Durston Road? 2 Thanks, Tim From: Ross Knapper<rl<napper@BOZEMAN.NET> Sent: Monday, November 8, 2021 10:42 AM To:Tim Staub<tstaub(@chengineers.com>; Lance Lehigh <1lehigh@BOZEMAN.NET> Cc: Nakeisha Lyon <nlyon@BOZEMAN.NET> Subject: RE: Nahorniak Commons-21034 Hi Tim, We have forwarded your question about the easement width to Chris Saunders for some additional input. Ross, would you be able to help set up a meeting for Lance and I to discuss this? Thank you, Tim Staub From:Tim Staub Sent:Wednesday, October 27, 2021 5:32 PM To: 'Lance Lehigh (Ilehigh(@BOZEMAN.NET)' <Ilehigh@BOZEMAN.NET> Cc: Nakeisha Lyon<nlyon@BOZEMAN.NET> Subject: Nahorniak Commons-21034 3 Hi Lance, I am getting back into the Nahorniak Commons site plan that you reviewed last winter. In your review letter from March 26, 2021 you had a comment on the required width of ROW dedication for Durston as being 50' (item 5 under easements). I am wondering if that can remain 45' as it was dedicated on the attached document number 2226667. For some reason when this property was annexed in 2019, that extra 5' didn't come up and the lot was annexed without it. Also, I have attached the plats of numerous neighboring subdivisions that only dedicated 45'.So if we give 50' we will be an island of 50' ROW in the sea of 45'. So at that point, what is the purpose of the extra 5'? In this particular instance can we keep it 45 feet? Thank you, Tim Staub, P.E.
