Landowner agreestheCityhas thesolerighttocontrolthedesignand constructionof such improvements and may includeany of theabove components and othersnecessarytoensuresuch improvements comply withalladopted City infrastructureplansand requirements.Further.the Landowner waives itsrightor tomake any writtenprotestagainstthe sizeor areaorcreationofthe districtbe assessedinresponseto a duly passed resolutionof intentionto createone or more special improvement districtswhich would includetheabove-describedproperty. slDWaiver Page2or3 In theeventa specialdistrictor specialimprovement districtisnot utilizedforthecompletion oftheseimprovements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthe completionof saidimprovements on a fairshare,proportionatebasisas determinedby theCityon the basisofthe squarefootageof property.taxablevaluationof theproperty,trafficcontributionfrom the development or a combinationthereof.
