What vegetation is present? Refer to section B4 in the instructions. A wetland delineation was performed at the project site on October 25, 2019 to determine the presence and extent of wetlands and waterways within the project area. The ordinary high-water mark of Middle Creek Ditch and a lateral of Middle Creek Ditch was delineated along with fringe wetland communities. In some cases, the waterway was completely vegetated in and then, as such, classified as wetland. The wetlands within the project area were dominated by reed canary grass (Phalaris arundinacea, FACW), fringed willowherb (Epilobium ciliatum, FACW), white willow (Salix alba, FACW), and Canada thistle (Cirsium arvense, FAC). The surrounding topography is relatively flat, and recreational yard “ponds” exist within the property. C. PROPOSED PROJECT OR ACTIVITY INFORMATION 1. WHY IS THIS PROJECT NECESSARY? STATE THE PURPOSE OR GOAL of the proposed project. Refer to section C3 in the instructions. The subject property will be subdivided and developed into a residential neighborhood. Additionally, adjustments and widening to Fowler Lane will need to occur in order to accommodate for this development. To accomplish this, portions of the lateral of Middle Creek will be piped and routed off the property to be subdivided/developed. The remnant unused portions of the ditch will be filled and graded. Portions of the pond features will be kept as open water features. Portions of Middle Creek Ditch that follow Fowler Lane will need to be relocated and re-routed to accommodate adjustments and widening of the road. 4. PROVIDE A BRIEF DESCRIPTION of the proposed project plan and how it will be accomplished. Refer to section C4 in the instructions. The proposed project will involve piping portions of the lateral of Middle Creek Ditch to route flow off the property located at 5400 Fowler Lane. The remnant unused portions of the ditch will be filled and graded. Portions of the pond features will be kept as open water features. The property will then be developed as the Buffalo Run Subdivision where single and multi-family homes will be developed. The portions of Middle Creek Ditch that run along-side Fowler Lane will be modified and or relocated in order to accommodate adjustments and widening of the road. 5. WHAT OTHER ALTERNATIVES were considered to accomplish the stated purpose of the project? Why was the proposed alternative selected? Refer to section C5 in the instructions. Two options were reviewed for the irrigation piping project: 1. Option 1: No action alternative. This option would involve not routing the irrigation lateral into pipes. This would lead to irrigation inefficiencies and leave less room for subdivision development. 2. Option 2: Routing the irrigation water into pipe within the property located at 5400 Fowler Lane. This action would allow for an efficient manner of transporting irrigation water while achieving the goal of the proposed project. Additionally, the irrigation ditch water flow along Fowler Road will be augmented to maintain flows while accommodating mandated road adjustments. 6. NATURAL RESOURCE BENEFITS OR POTENTIAL IMPACTS. Please complete the information below to the best of your ability. * Explain any temporary or permanent changes in erosion, sedimentation, turbidity, or increases of potential contaminants. What will be done to minimize those impacts? Few natural resource benefits exist with the proposed project activities. However, the overall impact to the resource and surrounding areas will be kept to the minimal extent possible. Irrigation water will still be delivered to downstream users. • Will the project cause temporary or permanent impacts to fish and/or aquatic habitat? What will be done to protect the fisheries? This irrigation ditches and laterals do not support fisheries. They are all controlled by headgates. • What will be done to minimize temporary or permanent impacts to the floodplain, wetlands, or riparian habitat? Appropriate BMPs will be identified and employed by the contractor and will likely include: silt fence, wattles, and straw bales. Only minimal vegetation will be removed in order to install the culvert project, and the BMPs will be installed prior to earth disturbing activities. All work will be conducted when irrigation water is not flowing through the system. • What efforts will be made to decrease flooding potential upstream and downstream of project? No streams are involved in this project. The project involves piping an irrigation lateral and making adjustments in the flow regime of an existing irrigation system. No disruptions of irrigation water delivery will occur. • Explain potential temporary or permanent changes to the water flow or to the bed and banks of the waterbody. What will be done to minimize those changes? The bed or bank of the irrigation lateral will be filled in after that irrigation water is piped. This is simply a change to a manmade system. • How will existing vegetation be protected and its removal minimized? Explain how the site will be revegetated. Include weed control plans. Only the minimal amount of vegetation will be disturbed with the implementation of proposed project activities. In order to prevent soil erosion and weed invasions, the disturbed areas within the project area will be reseeded with an appropriate seed mix: Tall Fescue: 40% Garrison Creeping Foxtail: 10% Western Wheatgrass: 15% Tufted hairgrass: 5% Slender Wheatgrass: 30% (Broadcast Seed at 25-40 lbs/acre) Any disturbed area with slopes exceeding 3:1 will be matted with biodegradable matting. A wetland delineation of the project area was conducted on October 25, 2019. A jurisdictional determination was sought in July 2021, but was not responded to until November 2021. While the project was in planning stages, these ditch laterals and associated wetlands were not considered jurisdictional. Because the definition of “waters of the US” is being used as a political football, impacts to waters of the US were not taken into consideration during project planning. 4. Will the project impact greater than 0.10-acre of wetland and/or more than 300 linear feet of stream or other waters? If yes, describe how the applicant is going to compensate (mitigation bank, in-lieu fee program, or permittee responsible) for these unavoidable impacts to waters of the United States. Refer to section F4 in the instructions. Impacts to wetlands associated with the ditch lateral are above 0.10 acre which will trigger the need for compensatory mitigation. The project owner will likely seek to offset these impacts through the purchase of wetland credits from the wetland bank. 5. (Morrison-Maierle) for Yellowstone Investment Group, PLLC (Client) on a 20 acre property located at 5400 Fowler Lane near Bozeman, Montana. The project area consists of 20 acres of property used for both residential and agricultural purposes (Appendix A, Figure 1). The subject property was evaluated for its content of potential jurisdictional wetlands and waterbodies, based on criteria set forth in the 2010 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys, and Coast Region (Version 2.0) (Environmental Laboratory 2010). Prior to the site visit, Morrison-Maierle reviewed existing project area literature including historical aerial photography, topographic maps, and hydrology data. A subsequent field evaluation was performed to identify hydric soils, hydrology, and hydrophytic vegetation. Vegetation communities were evaluated and documented to delineate wetland and upland boundaries. Based on the wetland delineation presented in this report and the data collected, it is Morrison- Maierle’s professional judgement that waters of the U.S. were present within the project area. The project area contains 0.59 acres of wetlands. Additionally, the project area contains 1,909 linear feet of waterways. The U.S. Army Corps of Engineers (USACE) and the U.S. Environmental Protection Agency (EPA) are the final authority over the jurisdictional status of both wetlands and waters of the U.S. per Section 404 of the Clean Water Act. The findings discussed in this report are solely the opinion of Morrison-Maierle and have not been verified by the aforementioned regulatory government agencies. 5400 Fowler Lane Wetland Delineation Page 1 1 Introduction At the request of the Client, Morrison-Maierle completed a wetland delineation 20 acres of property located at 5400 Fowler Lane, near Bozeman, Montana. The area of investigation covered approximately 20 acres of land located off Fowler Avenue in Bozeman, Montana (Appendix A, Figure 1). This technical report summarizes the findings of the wetland delineation. 2 Methods This wetland delineation utilized the methodology presented in the 1987 U.S. Army Corps of Engineers (USACE) Wetlands Delineation Manual (Environmental Laboratory 1987) and subsequent modifications outlined in the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys, and Coast Region (Version 2.0) (Environmental Laboratory 2010). The methodology includes sampling procedures for vegetation, hydrology, and soil parameters. Upland data points (UDP) and wetland data points (WDP) were established as needed during the field visit. Sample data points were labeled with an UDP or WDP, followed by the number associated with the data point, (e.g. noted here in bold (UDP 1) to correspond to the sample points for that location. Data for vegetation, hydrology, and soils were recorded in the field and entered on Wetland Determination Data Forms. Corresponding photographs were taken at each data point. Sample points and wetland boundaries (if present) were recorded using a Trimble® Geo 7X™ Global Positioning System (GPS) unit and post-processed to sub-meter accuracy. Locations were then converted to shapefiles uploaded into ArcMap 10.6.1 for display on figures included in Appendix A. 2.1 Vegetation Vegetation at upland and wetland data points was classified based on its wetland indicator status derived from the Montana 2016 State Wetland Plant List (Lichvar et al. 2016). Using the current plant list, vegetation cover qualifies as hydrophytic when over 50% of the dominant plant species have an indicator status of obligate (OBL), facultative wet (FACW), and/or facultative (FAC). FAC plants, such as Canada thistle (Cirsium arvense), are equally likely to occur in wetlands and non- wetlands. Vegetation cover was considered as upland where over 50% of the dominant plant species were classified as upland (UPL), and/or facultative upland (FACU). Plants observed within each data plot were identified using Montana Manual of Vascular Plants (Lesica 2012) along with other reference books. Vegetation nomenclature follows Lichvar et al. (2016) and Lesica (2012). 2.2 Soil Wetlands must meet the qualifications of at least one hydric soil indicator, or meet the definition of a hydric soil (a soil that formed under conditions of saturation, flooding or ponding long enough during the growing season to develop anaerobic conditions in the upper part (NRCS 2019a)). Soils at each data point were evaluated and described notating the depth, matrix color, mottle abundance and contrast (if present), texture, etc. (Environmental Laboratory, 1987 and 2010). 5400 Fowler Lane Wetland Delineation Page 2 Moist matrix color and moist mottle color of the soils were determined utilizing the Munsell Soil Color Chart (Kollmorgan Instruments Corporation, 2009). 2.3 Hydrology Primary and secondary hydrologic indicators were assessed at each wetland and upland data point; one primary indicator or two secondary indicators are required to qualify the area as containing wetland hydrology. Examples of primary hydrology indicators are saturation within 12 inches of the ground surface, surface water, and water table within 12 inches of the ground surface. Examples of secondary hydrology indicators are FAC-neutral test and geomorphic position on the landscape. 3 Results A wetland delineation of the project area was performed by Morrison-Maierle environmental scientists on October 25, 2019. The vegetation, hydrology, and soil characteristics at each of 7 data points were documented in the field and recorded on Wetland Determination Data Forms for the Western Mountains, Valleys, and Coast Region (Supplement, 2010). 3.1 Vegetation Vegetation communities were evaluated and documented to delineate wetland and upland boundaries. The upland herbaceous areas within the subject property were dominated by closely mowed lawn and upland pasture grasses. Identification of upland grasses was a challenge due to recent mowing and lack of seed-heads. The palustrine emergent wetlands within the project area were dominated by reed canary grass (Phalaris arundinacea, FACW), fringed willowherb (Epilobium ciliatum FACW), white willow (Salix alba, FACW), and Canada thistle (Cirsium arvense, FAC). The location of all data points are identified on Figures 5a and 5b of Appendix A. 3.2 Soil Mapped soil types within the project area were obtained from the Web Soil Survey (NRCS 2019b). Three mapped soils were identified in the project area: Hyalite-Beaverton complex, moderately wet, 0 to 2 percent slopes (448A), Turner loam, moderately wet, 0 to 2 percent slopes (457A), and Meadowcreek loam, 0 to 4 percent slopes (510B) (Appendix A, Figure 3). Soils were analyzed in the field for texture and color using the Munsell Soil Color Charts (Munsell 2009). Soils within upland areas exhibited a 10YR 2/2 (very dark brown) clay loam matrix. Soil within the wetland areas exhibited a 10YR 2/1 (Black) to 10YR 2/2 (very dark brown) clay loam to about 8 inches then with a 40% 10YR4/4 matrix below. The soil within the wetland area meets the characteristics of a Histic Epipedon (A2). 3.3 Hydrology 3.3.1 Topography The project area lies within the Bozeman, Montana (2017), U.S. Geological Survey (USGS) 7.5- minute Topographic Map. The project area is shown to be gently sloping to flat with elevations at approximately 5,000 feet above sea level (Appendix A, Figure 2). The Middle Creek Ditch is shown as occurring adjacent to the western most boundary of the subject property. During the 5400 Fowler Lane Wetland Delineation Page 3 site evaluation, the elevation and slope of the project area appeared to be consistent with the USGS topographic map. The ditch was also confirmed to be present within the project area. The EPA National Hydrography Dataset Plus (NHDPlus) was referenced to identify waterbodies within and near the project area (EPA 2019). The nearest surface water feature to the project area is a ditch to the west of the project area. 3.3.2 National Wetland Inventory The U.S. Fish and Wildlife Service maintains the National Wetlands Inventory (NWI), which serves as a publicly available resource that provides detailed information on the abundance, characteristics, and distribution of U.S. wetlands. According to the NWI database, several freshwater emergent wetlands (PEM1A) and two freshwater pond features are located within the investigation area (USFWS 2019). Appendix A, Figure 4 depicts the NWI features in the project vicinity. 3.3.3 Floodplains The project area is located within the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) panel 30031C0814D, effective September 2, 2011. The project area lies within an unprinted panel, therefore there is no flood plain data available (FEMA 2019). 4 Conclusions Based on the results of the wetland delineation performed according to USACE guidelines, it is Morrison-Maierle’s professional judgement that portions of the project area meets the technical criteria to be classified as waters of the U.S. The property located at 5400 Fowler Lane project area contains 0.59 acres of wetlands.
