Beall St Residential Development (The Lofts on Beall) Dear Lynn: Please find attached our conditional use permit application for 1608 W. Beall (The Lofts on Beall). This permit application is affiliated with a site plan application for the property. The project proposes to create eleven (11) residential units within two (2) separate buildings. This narrative provides information related to the conditional use permit (CUP) application, CUP application checklist, and Bozeman Municipal Code (BMC). A CUP is required as noted by comments from the Community Development Department dated July 20, 2021, and as shown below. The subject property (1608 W. Beall) is currently zoned in the City of Bozeman as B-2 Community Business District. The following image shows the property, and the zoning districts. Per BMC Table 38.310.040.C, townhouses/rowhouses are listed as a conditional use in the B-2 district. The site is bordered by R-3 residential to the north, R-2 residential to the northwest, and B-2 to the south, east, and west. Commercial businesses directly abut to the west (1624 W. Beall) and to the east (1602 W. Beall). 109 E Main Street, Ste B, Bozeman, MT 59715 I OFFICE 406.728.4611 I EMAIL wgm@wgmgroup.com Lynn Hyde May 25, 2022 Page 2 of 2 The site plan has been recently updated to include 5 or more attached residential units within each building; therefore, meeting the criteria of the BMC Footnote 7 which refers to Rowhouses/ Townhouses with “five or more attached units” as a permitted conditional use in the B-2 zoning district. Specifically, the project includes one residential building with 6 attached units at the front (north) side of the lot and one residential building with 5 attached units at the back (south) side of the lot. Access to the site is from W. Beall St. on the north side of the lot. The site is approximately 0.72 acres and slopes mildly to the north. The lot size and topography are adequate to accommodate the proposed use. The proposed development will not adversely affect the abutting properties. The new buildings are setback from property lines with additional buffer being from the adjacent parking areas. The shopping center to the south is also setback from the lot line and separated by an existing stormwater ditch which runs from west to east near the south lot line of the subject property. The single-family residential unit across W. Beall to the north (1605 W. Beall) will also not be adversely impacted. Existing access approaches to neighboring properties are adequately offset from the approach location which will access the subject lot. Landscaping will help provide buffers around the project site. The development will create a safe, healthy environment. The existing, abandoned concrete slab on the subject property will be removed. Existing old utilities on the south side of the site (light poles) will be abandoned or upgraded. The existing approach from Beall will be improved/upgraded. Existing groundwater monitoring wells associated with the Bozeman Solvent Site will be left in place and preserved. In summary, the proposed use (residential) will not have adverse effects on the surrounding properties. There is residential use adjacent and around the property. W:\Projects\210902\Docs\Misc\Conditional Use Permit\CoverLetter and Narrative for CUP App.docx CUP CONDITIONAL USE PERMIT CHECKLIST CONDITIONAL USE PERMIT APPLICATION PROCEDURE A Conditional Use Permit (CUP) allows a use that wouldn’t typically be allowed in an area but would be compatible with existing uses. A CUP is required for all uses listed as “conditional” in the Bozeman Unified Development Code (UDC). This handout provides details for the application requirements required to apply for a CUP. A CUP requires approval from the City Commission. CUP APPLICATION CHECKLIST 1. Create and submit a Planning application using the ProjectDox portal; 2. The digital copies must be separated into two categories: Documents and Drawings. a. The Documents folder should include items such as application forms, narrative, response to City comments, supplemental documents, technical reports, easements, legal documents, etc. b. The Drawings folder should include items such as site plans, civil plans, landscape plans, photometric plans, elevations, etc. All drawing files must be drawn and formatted for a 24” x 36” sheet file or 11” x 17” sheet file. Plan pages shall be properly oriented in landscape mode. Refer to our Quick Guide for additional information; 3. Naming protocol. All files should be numbered and named according to their order listed on your provided Submittal Checklist. File names should start with a numeric value followed by the document name. The numeric value at the beginning of the file name ensures the order in which they are displayed. Refer to our Quick Guide for additional information; 4. A project narrative providing a thorough description of what uses are being proposed and how they will function on the site. Include a detailed response to the following: a. How the site for the proposed use is adequate in size and topography to accommodate such use. b. How the proposed use will have no material adverse effect upon the abutting property. c. That any additional conditions stated in the approval are deemed necessary to protect the public health, safety and welfare. See Section 38.230.110.E.3, BMC for more details. 5. Location/vicinity map including area within one-half mile of site. 6. Site plan with north arrow, property dimensions, location of buildings, parking, driveways, off street loading, landscaping, location of utilities, access, pedestrian facilities and proposed use location. 7. Floor plans showing floor layout including square footage and proposed use for each room and area within the building. 8. For alcohol production sales and service and gaming uses, the floor plan shall show the complete layout of the restaurant with production/manufacturing/kitchen uses, gaming area and restaurant serving areas (seating) by location and square footage. 9.
