We,the undersigned Owners of therealpropertysituatedintheCounty of Gallatin,Stateof
Montana,and more particularlydescribedas follows:
TRACT C-1A OF THE AMMENDED PLAT OF WEST COLLEGE MINOR SUBDIVISION NO.195
IN CONSIDERATION of receiving Master SitePlan and FinalSitePlan approvalfrom the
City of Bozeman,along with accompanying rightsand privilegesand forotherand valuable
consideration,the receiptof which ishereby acknowledged,in recognitionof impactsto the
transportationsystem thatwillbe generatedby the development of the above-describedpropertyat
,have waived and do hereby forourselves,our heirs,personalrepresentatives,successorsand assigns,
the rightto protestthe creationof one or more specialimprovement districtsforthe constructionof
paying,curbs,gutters,sidewalks,storm drainage,lighting,trafficcontrol,for improvements of West
GarfieldStreet,S.27thStreet,and Fowler Avenue and the intersectionsof:
1.Fowler Ave.and W.GarfieldSt
2.Fowler Ave,and Huffine Lane
3.27thSt.and W.GarfieldSt.
4.W.GarfieldSt.and S.19m Ave.
5.W.College St.and S.19*Ave.
6.W.College,St.and Huffine Ln.
or to make any writtenprotestagainstthe proposed work or againstthe extentor creationof the districts
to be assessedin responseto a duly passed resolutionof intentionto createone or more special
improvement districtswhich would includethe above-describedproperty.
In the event an SID is not utilizedfor the completion of these improvements,the developer
agrees to participatein an alternatefinancingmethod forthe completion of saidimprovements on a fair
share,proportionatebasisas determined by squarefootage of property,taxablevaluationof theproperty,
trafficcontributionfrom thedevelopment or a combination thereof.
