HomeMy WebLinkAboutSID Waiver - Lot 7AInter-officeOriginalto:g y7 g eCityofBozeman4.f f GU U CityClerk (*n 3 2øg2unfË M Fee PO Box 1230 Bozeman MT 59771-1230 WAlVER OF RIGHT TO PROTEST CREATION OF SPECIAL DISTRICT OR SPECIAL IMPROVEMENT DISTRICTS [Ridge PUD Lot 7a -Permit #21-400] The undersigned owner of the realpropertysituatedin the County of Gallatin,Stateof Montana, and more particularlydescribedas follows: [Ridge AthleticClub Sub,Slo,T02 S,R05 E,Lot 7a,PlatJ-465-A] IN CONSIDERATION of receivingapprovalfora siteplanon thesubjectpropertyfrom theCity of Bozeman,along with accompanying rightsand privilegesand forother and valuableconsideration, thereceiptof which ishereby acknowledged,and inrecognitionoftheimpacts to Ferguson Avenue and Fallon Streetwhich willbe caused by the development of the above-describedproperty,the owner has waived and does hereby waive foritself,itssuccessorsand assignsforevertherighttoprotestthecreation of one or more specialdistrictsor specialimprovement districtsfor the design and engineering, constructionand maintenance of followingimprovements: a)Streetimprovements to Ferguson Avenue between Huffine Lane and Babcock Street includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. b)Streetimprovements to Fallon Streetbetween Ferguson Avenue and Cottonwood Road includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. c)Intersectionimprovements at Ferguson Avenue and Fallon Streetincludinglighting, 1 signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. d)Intersectionimprovements at Cottonwood Road and Fallon Streetincluding lighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. Landowner agrees the City has the sole rightto controlthe design and constructionof such improvements and may include any of the above components and othersnecessary to ensure such improvements comply with all adopted City infrastructureplans and requirements.Further,the Landowner waives itsrightor to make any writtenprotestagainstthe sizeor area or creationof the districtbe assessedin response to a duly passed resolutionof intentionto createone or more special improvement districtswhich would includethe above-describedproperty. In theevent a specialdistrictor specialimprovement districtisnot utilizedforthe completion of these improvements,the developer agrees to participatein an alternatefinancing method for the completion of saidimprovements on a fairshare,proportionatebasisas determined by the City on the basisof the square footage of property,taxablevaluationof the property,trafficcontributionfrom the development or a combination thereof This waiver ismade forthebenefitof the propertydescribedherein shallbe a covenant running with the land.
