B20-067 Please see the below responses that address recommended conditions of Approval. Recommended Conditions of Approval 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or State law. Response: Applicant acknowledges requirement to meet local and state codes. 2. The existing 10 foot utility easement must be released prior to final plat and cannot be shown on the final plat. Response: Applicant acknowledges requirement to release and reconvey the area devoted for the 10’ utility easement. A draft document is attached and will be executed prior to final plat. 3. If not already filed for the subject site, the applicant must provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special Improvement Districts (SID’s) Response: Draft SID waiver forms are included in the submittal. The applicant will execute waivers prior to final plat. 4. The proposed project falls within the Bozeman Solvent Site boundary. The property is underlain by an aquifer contaminated with perchloroethylene (PCE). No irrigation wells may be installed on this property and any excavation and dewatering will required additional construction oversite. Please contact the Montana Department of Environmental Quality for additional information on construction requirements within the solvent site. Response: The applicant has already coordinated the work with the Montana DEQ, and a groundwater discharge permit (MTG071090) has been issued for the project (Attached). NOVEMBER 2, 2021 PAGE NO. 2 tdhengineering.com 5. There is a discrepancy in the number and location of water main valves between the preliminary plat and the master site plan. The proposed water main plan must match the master site plan prior to final plat. Response: The approved infrastructure plans match the approved MSP. Final plat will reflect the approved MSP documents. 6. Due to high known groundwater conditions in the area no basements will be permitted with future development of the site. No crawl spaces will be permitted with future development of the site, unless a professional engineer registered in the State of Montana certifies that the lowest point of any proposed structure is located above the seasonal high groundwater level and provides supporting groundwater data prior to the release of building permit. In addition, sump pumps are not allowed to be connected to the sanitary sewer system. Sump pumps are also not allowed to be connected to the drainage system unless capacity is designed into the drainages system to accept the pumped water. Water from sump pumps may not be discharged onto streets, such as into the curb and gutters where they may create a safety hazard for pedestrians and vehicles. Response: The applicant acknowledges the requirement to avoid basement and crawl space foundations.
