Please see the attached Staff Report for the analysis and the conditions of approval. All conditionals must be met before the site plan is granted Final Plan approval. When all conditions of approval have been met, please provide a written Memo describing how and when the conditions were met. Please note that a sign noting the approval of the Commercial Certificate of Appropriateness (CCOA) for the demolition of the parking lot and portion of the Medical Arts Building and for the design of the new building must be posted at the property at this time. Please contact Mr. Ross Knapper for the sign to be posted. He can be reached at rknapper@bozeman.net. As the Applicant, you must comply with all provisions of the Bozeman Municipal Code (BMC) which are applicable to this project as noted in the staff report. All unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. Please be informed that ANY changes from the site plan approved by the Director will need to be reviewed and approved by the Department of Community Development. If Impact fees have been paid and/or Cash-in-Lieu contributions have been submitted, please provide a copy of each of those receipts. If you desire an estimate of the required impact fees according to current rates, please contact Mr. Chris Saunders of the Department of Community Development at csaunders@bozeman.net. This Director of Community Development project decision may be appealed filing a notice of appeal with the Clerk of the Commission for the City of Bozeman, within ten working days after the date of approval as evidenced by the Director’s signature, by following the procedures of Section 38.250.030, BMC.
