Thanks, Brian From:R Hudock <rhudock@chengineers.com> Sent:Tuesday, October 6, 2020 11:44 AM To:Brian Heaston <bheaston@BOZEMAN.NET> Subject:RE: Fallon Apartments -CILWR Hello Brian, For the Fallon Apartments Site Plan, we understand that 34 CILWR credits are needed. The owner, Kevin Spencer, would like to apply 22 of the CILWR credits he owns. Therefore, CIL payment would be needed on the remaining 12 CILWR credits. Can you please confirm whether this would be acceptable? We will need to provide documentation of this as part of this site plan application. Thanks a ton! Ryan From:Brian Heaston <bheaston@BOZEMAN.NET> Sent:Friday, September 25, 2020 4:17 PM To:R Hudock <rhudock@chengineers.com> Subject:RE: Fallon Apartments -CILWR Gotcha.Platted lots purposed for future multi-family development pay 1 MF unit per lot at the time of platting. The remainder are paid with site plan since that is when the unit density is known. Two lots give you 2 MF units already paid for a remaining balance of 34 MF units. Kevin Spencer has a sizeable quantity of CILWR credits available for his use.If written confirmation from him is provided we’ll debit the volume of 34 MF units (34*0.124 AF = 4.22 AF) from his available credit balance. Hope that helps clear things up. Was CIL Water Rights for any MF units previously paid for on this specific property (Lots 2 & 3 of Block 13, Norton Ranch Subd., Ph. 4)?It sounds like 2 had been previously paid for so therefore payment on the remaining 34 units is needed.Does that sound right? Thanks Brian, have a great weekend! Luke Stein, E.I. Hope that helps. From:L Stein <lstein@chengineers.com> Sent:Friday, September 11, 2020 9:51 AM To:Brian Heaston <bheaston@BOZEMAN.NET> Cc:Ryan Clark <rclark@chengineers.com> Subject:RE: Fallon Apartments -CILWR Hey Brian. An alternative number is (406) 404-7520. We have been having some issues with the busy tone but this number will bypass it. Anyways, what I wanted to discuss was how the multi-family units are calculated for water rights. From the spreadsheets you sent over, it appears that 1 MF unit is the same as 1 single family unit. Lots 1-3 of Block 13 had 3 MF units of water rights paid with the final plat of Phase 4. With this site plan (Lots 2 & 3 of Block 13), there are two multi- family buildings, each with 18 dwelling units. It appears the City is requesting that Norton Homes now pay the additional 34 MF units of water rights because only 2 units were paid for. It was mine and Doug Lee’s understanding that the 1 MF unit covered the MF building. If you could clarify how the MF unit is calculated, I can send that information over to Doug and Kevin to get their sign off. Thanks Brian! Luke Stein, E.I. Can you confirm if water rights were provided for Lots 2 &3, Block 13, Norton Ranch Subdivision, Phase 4 (plat attached) The proposal includes two new apartment buildings, each 18-units (36 total for the project). I’ve attached a draft layout of the site for your reference. If water rights were previously provided –do they cover this proposed use? Thanks, Luke Stein, E.I.
