Olive Street Bozeman, MT 59718 RE: Narrative Response to DRC Memo — Westland Lofts Phase 2 Site Plan Application from August 12, 2020. (COB #20-189, C&H#171281). Dear Danielle, This letter is to provide a narrative response to the comment provided in the August 12"', 2020 DRC comments from Planning: 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. The above-noted requirement is understood. SITE PLANNING 1. 38.520.040.D—Non-motorized circulation and design. a. Where a pathway is adjacent to perpendicular parking, an extra 2-feet of walkway width must be provided to mitigate for parked vehicle overhang. Where perpendicular parking is located in front of building D the sidewalk needs to be 7-feet wide. b. Staff supported a departure with the Master Site Plan approval to eliminate the 3- foot landscaping strip between the building and the walkways if permanent planters are provided on the interior elevations. The planters are not shown on the Building D elevations. The pathway in front of Building D has been increased to meet the 7-foot requirement. The planters are included on the Building D elevations. Civil/Structural Engineering and Surveying ENCROACHMENTS AND LANDSCAPING 1. Clarify if there are ground level patios on the east side of Building C. Sliding doors and fencing are shown in the architectural plans, but the landscaping plan shows planting beds in those locations. Staff recalls easement and encroachment issues with the patios during the master site plan review. Rectify the landscaping and architectural plan discrepancies. The patios with privacy screening will be included on the east side of Building C. The landscaping plans have been adjusted to reflect this. BUILDING COMMENTS, Bob Risk, brisk@bozeman.net 1. Sprinklers and alarms required. This item is noted, the buildings will have sprinklers and alarms. NORTHWESTERN ENERGY COMMENTS, Tom Stewart, thomas.stewartknorthwestern.com 1. If the transformer for building D is going to be located at the place shown on the plans there needs to be 10-foot easement from the utility easement boundary to the north down to the transformer pad to include the transformer pad. A 10' utility easement has been provided to the transformer for building D and C. 2. If the transformer is going to be installed close to the curb protective bollards will need to be installed, according to NWE standards, on the curb side of the transformer. Or install the transformer back away from the edge of the curb about three feet and bollards can be omitted. Bollards have been added to the site plan. 3. The service length from the transformer to Building C looks to be less than 100' which is acceptable. The item is noted. 4. The transformer will need to be 10' from the water services. The services have been moved so that the transformer is 10'from the water services. 5. In regards to Landscaping, please remove all large trees from the utility easement. Large trees have been removed from the utility easement. 6. Meter locations will need to be approved by NWE. NWE policy is to maintain Civil/Structural Engineering and Surveying a minimum of 3-feet between the front of the meter and landscape screening and allow easy access to the meters for operation and maintenance. This can be determined through the design process after an application is submitted through NWE and the area engineer will work through allowable shrubs and plants for screening and to determine adequate clearances for access to our meters. This item is noted. 7. It is my recommendation that they submit a service application to NWE as soon as possible to get the process started. This will assure working with the NWE engineer that it gets started in the right direction. This item is noted. ENGINEERING 1. BMC 38.410.060.- Easements: a. Please provided a copy of the recorded water main easement with the Phase 11 site plan. A signed copy of the easement from the master site plan is included. The easement will need to be signed by the City of Bozeman and routed through the City to the clerk and recorder. 3. BMC 38.410.070 - Municipal water, sanitary sewer and storm sewer systems: a. Concurrent construction must be approved for Phase II if building permits for the current site plan are to be approved prior to completion the water main,per BMC 38.270.030.C. If concurrent construction is requested after the Phase II site plan has been approved a modification application will be required. A new Irrevocable Offer of Dedication will be required with the request. b. Per Condition of Approval No. 3 of the Master Site Plan, Application No. 18557 Phase 2 will exceed the allocated capacity for this property within the Baxter Meadows Lift Station as such Phase 2 cannot receive final site planibuilding permit approval until additional capacity is created downstream as determined by the City's Engineering Department (e.i: the Norton East Wastewater Interceptor is constructed to take demand from Baxter Meadows Lift Station, the Baxter Meadows Lift Station is upgraded, or an alternative.). Concurrent construction has been included with the site plan application. A draft of the of Irrevocable Offer of Dedication is included with this resubmittal. The necessary improvements to provide additional downstream capacity are under construction, it is noted that approval will not be given until these are completed Advisory Comments: Civil/Structural Engineering and Surveying 1. The applicant must prepare plans and specifications for any fire service line in accordance with the City's Fire Service Line Policy. The plans must be prepared by a Professional Engineer and be provided to and approved by the City Engineer prior to initiation of construction of the fire service or fire protection system. The applicant must also provide Professional Engineering services for construction inspection, post-construction certification and preparation of mylar record drawings. Fire service plans, and domestic services 4" or larger, must be a standalone submittal, separate from the site plan submittal. City of Bozeman applications for service must be completed by the applicant. This item is noted. Fire service plans have been submitted to the City of Bozeman.
