UNDERGROUND UTILITY EASEMENT
Dallas Financial LLC, a Nevada Limited Liability Company, of P.O. Box 12009, Bozeman, MT
59719, the GRANTOR, in consideration of one dollar and other good and valuable
consideration, receipt of which is acknowledged, does hereby grant to Northwestern Corporation
d/b/a Northwestern Energy, a Delaware Corporation, of 11 E. Park Street, Butte, MT 59701-
9989, the GRANTEE, its successors and assigns, two easements of variable width upon which to
construct, operate, maintain, replace, upgrade and remove an underground electric line,
communications system, gas line, and necessary appurtenances over, under, along, and across
those certain a strips of land located in Gallatin County, Montana, to be located on the following
described real property:
Lot 5, Block 14, Baxter Meadows Subdivision, Phase 6, City of Bozeman, according to
the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin
County, Montana and located in the SE 1/4 of Section 34, T. 1 S., R. 5 E. of P.M.M..
The easements are more particularly shown and dimensioned on the attached Exhibit A, which
by this reference is made a part of this document.
TOGETHER with reasonable right of access to and from the easement areas over lands of the
Grantor using existing roads and trails where practicable; the right to use and keep the easement
areas free and clear of any and all obstructions or structures, except fences; and the right to clear
and remove all timber, brush, or vegetation outside of the easement areas that may, in the
Grantee’s sole opinion, endanger the powerline, communications system, gas line, or necessary
appurtenances.
The GRANTOR states that it possesses the real property described above and that it has a lawful
right to grant an easement thereon.
