Box 1230 Bozeman, MT 59771-1230 Re: Bozeman Gateway Phase 5 – Preliminary Plat Resubmittal COB#: 20094 MMI#: 3638.009 Dear Sarah: This letter is to provide written responses to the comments stated in the DRC review memo dated April 19, 2021. Below are our responses associated with each comment. Planning Division, Sarah Rosenberg, srosenberg@bozeman.net SECTION 2- CODE CORRECTIONS 1. 38.420.110. There is an identified proposed trail as identified in the PROST Plan along the south side of Technology Blvd. This shared use path should be on the south side of Technology Blvd close to the ditch. Show the 25’ wide trail easement with a 10’ wide concrete shared use path on the preliminary plat. This will need to be constructed with the improvements of the subdivision. A 10’ wide concrete shared use path is shown on the south side of Technology Blvd. West. It is shown within the right-of-way and easement received from MSU. 2. See attached Engineering comments See attached Engineering comments letter. Advisory Comments: 1.Any construction in lot 1 cannot build within the watercourse setback unless exempt per 38.410.100.A.2. This could affect the hotel site plan. The DRC would not support an encroachment or variance to allow for the construction of a building into the watercourse setback. The proposed hotel is not within the watercourse setback. The PUD received a relaxation to encroach into 50-foot watercourse setback. Attached is Jurisdictional Determination from the Corp of Engineers stating the ditch is non-jurisdictional.
