Box 1230 Bozeman, MT 59771-1230 Re: Bozeman Gateway PUD – Development Manual Modification Application – Revision COB#: 20051 MMI#: 3638.009.040.0310 Dear Sarah: Attached is a revision of the Modification to an Approved Plan Application for changes to the Bozeman Gateway Development Manual. Below are the comments you provided in a letter dated December 21, 2020. Our responses (in red) follow each comment. Section 2 – Recommended Conditions of Approval: 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. Understood. 2. All lighting that references the allowance for 4000K in the Development Manual must be adjusted to 3000K. Added language on Page 25 to specify 3000k lighting shall be used in ROW. 3. No property may be removed from the PUD or covenants without written approval of the City of Bozeman. Understood. 4. The City of Bozeman has relied upon the overall design and design standards required as part of the planned unit development application. The design and design standards may not be altered without consent of the City. Understood. Section 3 – Requested Relaxations: BMC 38.210.010.C DRB Review – Request to remove the requirement for any project within the Bozeman Gateway PUD to be reviewed by the Design Review Board as outlined in the original adoption of the Bozeman Gateway PUD (Z-05217), condition of approval number 40. o The DRC is in support of this request. Development within the PUD that meets the review threshold of 38.230.040 still requires DRB review. Understood. BMC 38.310.040.C. Residential in the B-2 zone district. Allow residential on the first floor in a B- 2 zone district with the need for a Conditional Use Permit or a Special Use Permit. o The DRC is in support of this request. Understood. BMC 38.320.050. Building Height in the B-2 zone district. Request to remove the 65 foot height allowance from the original Bozeman Gateway PUD (Z-05217), condition of approval number 42 and to allow for a building height of 85.8 feet without the need of a conditional use permit and to be reviewed administratively through the site plan process. Removed Building Heights Relaxation regarding approval of B-2 Zone on Page 97 o Combine building height relaxations into one. The property is now considered Regional Commercial by the Growth Policy that was adopted November 17, 2020. Combined. o The DRC is in support of this request. The Bozeman Gateway PUD is designated as regional commercial and services growth policy land use designation which allows for a 50% increase to building height (up to 66’). An additional 30% increase to height can be requested through a CUP (38.320.050-Note 7) which would allow for a building height of 85.8 feet. The granting of this relaxation would allow for any building in the Bozeman Gateway to be 85.8 feet without the need of a CUP. Understood. BMC 38.410.100.A.2.e.(3)(d). Allow concrete path in watercourse setback. o After further review of the Preliminary Plat Phase 5 and this PUD, the following should be addressed: Alter asphalt trail to become a sidewalk along Fowler as there will need to be a sidewalk installed with phase 5. Based on 38.410.100.A.2.e, sidewalks are permitted within all zones. This sidewalk should follow the entirety of Fowler and reflected in all of the site plans. There should then be bridges that cross the creek to access the buildings within phase 5. We recommend that a bridge and east west sidewalk connection be installed in the following locations (or close to) as shown in the image below: Exhibits have been updated to reflect path against Fowler Ave, as well as crossing to hotel and pad sites. BMC 38.570.030 Street Lighting. Allow street lighting within the Bozeman Gateway PUD to be 4000K rather than 3000K. 5. The DRC is not in support of this relaxation. The City of Bozeman Design Standards and Specifications Policy allows for a maximum of 3000K along the right of way in commercial areas (Section XIII. Streetlight Luminaires). This standard is set by the ANSI C78.377-2011 standard and that the 3000K color temperature is a softer light than 4000K and has less light intrusion. Added language on Page 25 to specify 3000k lighting shall be used in ROW. o Section 4 – Required Code Corrections: Planning Division; Sarah Rosenberg, srosenberg@bozeman.net, 582-2297. 1.Pg. 47 – Under Bozeman Gateway Core, the height should be removed if there is an overall relaxation request to the development. Removed 50ft height restriction. 2. Pg. 55 – the UDC requires a minimum canopy/awning projection of 3 feet. This should be reflected under 8.b. Changed 2’ to 3’. 3. Pg. 56 – Under C.1.j, LED string lighting is now allowed per the Dark Sky Ordinance and the BMC. This cannot be a standard in the Development Manual. Changed “highly regulated by GRB” to “must comply with COB UDC”. 4. Pg. 61 – Show window graphics are referred to as window signs in the BMC and are not allowed to be more than 25% of the area of the window per 38.560.060.A.3.a. Please adjust this in the Development Manual. Added language to differentiate between Window Signs and Show Window Graphics/Lifestyle Images. 5.Pg. 66 – remove PLS checklist as it is no longer a City checklist. Removed. 6.NOT ADDRESSED: Pg. 72 – There should be additional bicycle parking in phase 1, 3, and 5. These can be identified as ones that already exist. Is this additional to the bicycle parking requirements that will be required with site plan applications? How will these be determined when they will be built? Please clarify. Updated exhibit to identify parking in Phases 1, 3 & 5. Added language to specify when bike parking when be constructed. 7.Pg. 74 - Internal roadway should apply to the grocery store. Updated exhibit. 8. Pg. 103 – Since the cost per square foot for cash-in-lieu of parkland has changed (now is $1.72) and could possibly change prior to final plat approval of phase 4, the tracking table cash-in-lieu estimate column should be removed.
