BMC 38.270.020.A.1 – Construction Route a. New: The construction route must be revised to eliminate Catron Street (a local street) from the construction route. The route map must be expanded to identify the principal arterial streets providing access to the project. The updated route no longer indicates how construction traffic will access the site. The route must minimize construction traffic on local streets or impacts to the public. The applicant’s response is incorrect that only local streets surround the project. Catamount directly adjacent is an arterial street. Response: The Construction Route Map on Sheet C0.1 has been corrected. Storm Drainage d. Please identify the gravel bedding dimension for the respective CMP subsurface systems on the plans. – Dimensions have not been identified on the plans. Detail 9 on Sheet C2.0 calls out 12” min to surround the CMP piping, however Basin B requires addition bedding (bedding width (4.75’)-pipe diameter (2.5’) = 2.25’). More over the groundwater section (Section C) of the stormwater report calls out 6” of porous stone to surround the pipe. Basin C requires a bedding depth of 4 feet or a minimum of 12” above and below the pipe. As such a portion of the required volume for basin C will be inundated by groundwater. The applicant must correct or clarify these discrepancies. Response: The detail on Sht C2.0 has been revised to match the design for each infiltration basin. Recommended Conditions of Approval: 1. If not already filed for the subject site, the applicant will need to provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special Improvement Districts (SID’s) for the following: a. Street improvements to Catamount Street including paving, Palisades Condominiums – Site Plan Review Comment Narrative Page 2 of 3 curb/gutter, sidewalk, and storm drainage b. Street improvements to N 27th Avenue from Cattail Street to E Valley Center Rd including paving, curb/gutter, sidewalk, and storm drainage c. Street improvements to Davis Lane Cattail Street to Catamount Street including paving, curb/gutter, sidewalk, and storm drainage d. Intersection improvements for Catamount Street and N. 27th Avenue e. Intersection improvements for Catamount Street and Warbler Way f. Intersection improvements for Catamount Street and E Valley Center Road The document filed must specify that in the event an SID is not utilized for the completion of these improvements, the developer agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property, traffic contribution from the development, or a combination thereof. The applicant must provide a copy of the filed SID waiver prior to Site Plan approval. A. The City has update the SID waiver language, please see attached. The draft waiver must be update. – The waiver must be recorded and a copy provided to the City. – The City doesn’t file the SID waiver, this must be done by the property owner. Providing the City an original executed but unrecorded waiver does not satisfy this condition. Response: The SID waiver has been recorded with the County Clerk & Recorder. A copy of the recorded document is included in this resubmittal. Advisory Comments: 1. Plans and Specifications for water and sewer main extensions, streets, and storm water improvements, prepared and signed by a professional engineer (PE) registered in the State of Montana shall be provided to and approved by the City Engineer. Water and sewer plans shall also be approved by the Montana Department of Environmental Quality. The applicant shall also provide professional engineering services for construction inspection, post-construction certification, and preparation of mylar record drawings. Construction shall not be initiated on the public infrastructure improvements until the plans and specifications have been approved and a preconstruction conference has been conducted. Building permits will not be issued prior to City acceptance of the infrastructure improvements unless all provisions set forth in Section Palisades Condominiums – Site Plan Review Comment Narrative Page 3 of 3 38.270.030.C of the Bozeman Municipal Code are met to allow for concurrent construction. If concurrent construction is requested after the site plan application a modification application must be submitted through the Community Development Department. – No request for concurrent construction has been received with this site plan. Response: A Concurrent Construction request, with the Fire Marshall support letter is included in this resubmittal. 2. The civil plans incorrectly define the right-of-way along Catamount St. Response: The right of Way width has been corrected. END OF NARRATIVE
