With the basin closure and then the groundwater ruling in 2005, one can no longer feasibly permit irrigation in the Bozeman Solvent Site, due to the way the controlled groundwater area was set up (no clear exception to permitting – thus mitigation requirements apply). This is probably what the City is inquiring about, as the Bozeman High School ran into the same problem. Unless we can find a water right on record currently with MT DNRC, the well(s) are not permitted for use. The original 1989 facility had 2 wells (for domestic and fire protection) that have been used for lawn irrigation since the building was connected to City water in 2000/2001. This appears to be generally allowable per language in the ROD (highlighted pages attached), but the City is asking for some confirmation on the permitted use of these wells as part of their project review. Do you know if it would be possible to get a copy of the well disconnection file for Gibson Guitar (B-05). Per the BSS ROD and CECRA file guides it should be DEQ File No. 20-03-05-02-04-05. Or if you have any other information regarding the continued use of these wells for lawn irrigation, it would be much appreciated.
