The proposed deviation from BMC 38.400.060 is not applicable to the building elevation and does not impact the building height or other applicable standards. 19. We would like to request a departure from BMC 38.400.060 to reduce the size of the requested right-of-way along Orville Way. City engineering is requesting an arterial street right-of-way, and we feel this would negatively impact our design proposed design and make the optimal building layout for a manufacturing space less efficient. Additionally, as stated in the waived traffic study, we are anticipating only a minimal increase in traffic, and an arterial street right-of-way is inappropriate for Orville Way as it will only be serving local traffic into the future. We propose to update the North side of Orville Way with curb and gutter, public access easement, storm water drainage, and site lighting to enhance the 31’ local road right-of-way on Orville Way and provide an effective transition at the pedestrian scale. 20. See below for an exhibit clearly showing the proposed departures related to Other Frontage building placement requirements. The impacted area proposed as a departure is shown in the yellow region, located in the right of way on Orville Way.
