RESOLUTION 5177 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS TRACTS OF LAND, HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACT, BLACKWOOD GROVES ANNEXATION,APPLICATION 20020. WHEREAS, the City of Bozeman received a petition for annexation from Blackwood Land Fund, LLC current landowners of record, requesting the City Commission to extend the boundaries of the City of Bozeman so as to include an area of land containing approximately 120.99 acres; and WHEREAS, the current landowner of record of real property consisting of one parcel of land described in Section 1, requested the City Commission to extend the boundaries of the City of Bozeman; and WHEREAS, an annexation staff report was prepared in accordance with the Commission's goals and policies for annexation and was presented to the Commission on June 15, 2020; and WHEREAS, a public meeting on said annexation petition was duly noticed and held on June 15, 2020; and WHEREAS,the City did not receive any written protest from the real property owners of the area to be annexed; and WHEREAS, on June 15, 2020, the Commission approved the annexation subject to an annexation agreement which was signed by the current land owner prior to the public hearing; and Resolution of Annexation 5177 Blackwood Groves Annexation Page 1 of 3 DocuSign Envelope ID:6614EF1 B-8E70-46DB-813E-D6AFBB7B6DB8 WHEREAS, the provision of available services, including, but not limited to, streets, rights-of-way, easements, water rights or cash-in-lieu, waivers of protest against creation of SIDS, and water and sewer hookup fees, to said contiguous tracts is the subject of a written agreement between the City and the Landowner; and WHEREAS, the Bozeman City Commission hereby finds that the annexation of this contiguous tract is in the best interests of the City of Bozeman and the inhabitants/owners thereof. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,Montana,that: Section 1 That it is hereby declared that,pursuant to Title 7,Chapter 2,Part 46,M.C.A.,the following- described property, which is contiguous to the municipal boundaries of the City of Bozeman, be annexed to the City of Bozeman and that the boundaries of said City shall be extended so as to embrace and include 120.9877 acres,to wit: Legal Description The property is described as: The S '/z, SW '/4 of Section 24, and the N '/2,N'/2, NW '/4 of Section 25, Township 2 South, Range 5 East, P.M.M., Gallatin County, MT, except that part conveyed to the State of Montana for highway right-of-way purposes for South 19th Avenue, State Project S 243(1), by bargain and sale deed, recorded in Book 144 of Deeds, Page 148. Also, a portion of the adjacent right of way of South 19`h Avenue, State Project S 243 (1). Said property is all described as follows: Beginning at the center-south one-sixteenth corner of said Section 24; thence southerly 181°24'39", assumed azimuth from north, 1316.63 feet along the east line of the Southwest Quarter of said Section 24; thence southerly 181°44'45" azimuth, 666.45 feet along the east line of the Northwest Quarter of said Section 25; thence westerly 269057'02" azimuth, 2599.67 feet along the south line of the North Half of the Northwest Quarter of said Section 25, to the east right of way line of South 10 Avenue, State Project S 243(1); thence continuing westerly 269057'02" azimuth, 100.00 feet to the west right of way line of said South 19'h Avenue; thence northerly 001°09'12" azimuth, Resolution of Annexation 5177 Blackwood Groves Annexation Page 2 of 3 DocuSign Envelope ID:6614EF1B-8E70-46DB-813E-D6AFBB7B6DBB 665.32 feet along the west right of way line of said South 191 Avenue; thence easterly 090°54'40" azimuth, 50.00 feet along the south line of the Southeast Quarter of Section 23, Township 2 South,Range 5 East to the southeast corner of said Section 23; he easterly 089050'46" azimuth, 50.00 feet along the southwest corner of said Section 24; thence northerly 000°02 23 azimuth, 1331.71 feet along the east right of way line of said South 19`li Avenue; thence easterly 09001 '00" azimuth, 300.25 feet along the north 24; thence easterly 090°15103" ine of the South Half of the Southwest Quarter of said Section azimuth, 1337.87 feet along said north line to the point of beginning. Section 2 The effective date of this annexation is June 23, 2020.
