The Gallatin City-County Health Department does not issue any permitting or “approvals” for enclosures, but please note that any “smoking shelter” must comply with the Montana Clean Indoor Air Act, Department of Public Health and Human Services regulations, and Gallatin County Board of Health’s 2018 Montana Clean Indoor Air Act Enforcement Policy. Here are links to the relevant Montana statues and regulations: MCA 50-40-103 Montana Clean Indoor Air Act: Definitions MCA 50-40-104 Montana Clean Indoor Air Act: Smoking in Enclosed Public Places Prohibited ARM 37.113.101 Montana Clean Indoor Air Act: Definitions. Includes definition of an “enclosed room” A copy of the Board’s 2018 Montana Clean Indoor Air Act Enforcement Policy is attached. Please let me know if you have any additional questions.
