CREAIION OF SPECIAL IMPROVEMENT DISTRICTS

We, the undersigned Owners of the real property situated in the County of Gallatin, State ofMontana, and more particularly described as
follows:
IN CONSIDERATION of receiving the Cityof Bozeman, along with accompanying rights and privileges and for other and valuable consideration,
the receipt of which is hereby acknowledged, in recognition of_

have waived and do hereby for ourselves, our heirso personal represeniativer, ,u***ilundassigns, the right to protest the creation of one or more speciai improvement districts for the constructionof:
d . Streel improvements to East Valley Center Road including paving, curb/gufter, sidewalk, and
storm drainage
b . Street improvements to North 19'r'Avenue including paving, curb/gutter. Sidewalk, and storm
drainage
C . Intersection improvements for East Valley Center Road and North lgtr'Avenue
d . Intersection improvements for North l9d'Avenue and Burke Street
€ . Intersection improvements for Max Avenue and canrron Street
f - Intersection improvements for Max Avenue and cattail Street
or to make any written protest against the proposed work or against the extent or creation of the districtsto be assessed in response to a duly passed resolution ofinteniion to create one or more specialimprovement districts which would include the above-described property.
In the event an SID is not utilized for the completion ofinese improvements, the developeragrees to participate in an altemate financing method for the completion of said improvements on a fairshare, proportionate basis-as determined by squarefootage ofproperty, taxable valuation ofthe property,traffic contribution from the development or a combination thereof.
This waiver shall be a covenant running with the land and shall not expire with the dissolution ofthe limited paftnership, provided however this waiver shall apply to the lands herein described.The terms, covenants and provisions of the Waivei shall extend to, and be binding upon thesuccessors-in-interest and assigns of the parties hereto.
