RESOLUTION 5173
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AUTHORIZING THE CREATION & ESTABLISHMENT OF RIGHT-OF-
WAY FOR A CITY STREET ACROSS PARCEL 12-C-1 OF THE AMENDED PLAT OF
LOT 12-A, 12-B, AND 12-C, AMENDED PLAT OF LOT 12 PHASE 1, GALLATIN
CENTER SUBDIVISION P.U.D., PHASE 4 FOR PURPOSES OF PROVIDING
ADDITIONAL RIGHT-OF-WAY FOR THE MAX AVENUE AND CATTAIL STREET
INTERSECTION.
WHEREAS, a portion of parcel 12-C-1 of the Amended plat of lot 12-A, 12-B, and 12-C,
Amended Plat of Lot 12, Phase 1, Gallatin Center Subdivision P.U.D. Phase 4 was dedicated to
the city on May 22, 2020; and
WHEREAS, the creation and establishment of a public street across parcel 12-C-1 of the amended
plat of lot 12-A, 12-B, and 12-C, Amended Plat of Lot 12, Phase 1, Gallatin Center Subdivision
P.U.D. Phase 4 is necessary to the development of the intersection of Max Avenue and Cattail
Street and will serve the public interest by improving traffic flow through the intersection,
providing increased capacity, and providing increased public safety.
NOW THEREFORE BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, as follows:
Section 1
The City Commission hereby establishes and creates a public road right-of-way across a portion
of parcel 12-C-1 of the amended plat of lot 12-A, 12-B, and 12-C, Amended Plat of Lot 12, Phase
1, Gallatin Center Subdivision P.U.D. Phase 4 as shown on Exhibit A.
Section 2
This Resolution is to be recorded in the records of the Gallatin County Clerk and Recorder.
