Ensure that all setbacks are annotated on the site plan. Response: All setbacks are shown on the Site Plan. 2. BMC 38.420. A Parks Plan must be provided with formal submittal showing how it will relate to the Graf Street Apartments park, connectivity to the trail, and other amenities. a. BMC 38.420.060. The proposed park does not meet frontage requirements and a variance is required. To sway the park from appearing as a private park, providing a variety of amenities in the park could help with support of the variance. This could include things such as a plaza, cycletrack, one way road with angled parking (per Engineering approval), a separate parking lot, sports courts, amphitheater, etc. Response: The park plan has been designed in conjunction with the 2131 Graf Park Plan (Graf Street Apts) project. A variety of amenities have been provided to compensate for the reduced park frontage and required park area. 3. BMC 38.510. The following block frontages apply: a. BMC 38.510.030.C: Landscape b. BMC 38.510.030.E Trail/Park i. For residential structures, frontages must comply with mixed block frontage standards C. BMC 38.510.030.J: Special Residential Response: The proposed development has been designed per the appropriate street frontage requirements. 4. BMC 38.510.030.L. A community design framework master plan must be developed, approved, and recorded for the property per the procedures set forth in Section 38.230.130. Response: A Master Site Plan is being submitted with the application. 5. BMC 38.520.040.C.2. Provide direct pedestrian access between all ground related unit entries and a public street or to a clearly marked pathway network or open space. BMC 38.520.060.B.2.Ensure appropriate and adequate connection to common open space areas. Provide detailed plans of each individual open space and how they will be highly amenitized. Response: All common open space has adequate connectivity. 7. BMC 38.530.050.B. All windows must include trim or other design treatment or alternatively be recessed at least 2 inches from the fagade. Response: Windows have been designed per the City standards. 8. BMC 38.530.050.E. Primary building entrances must be clearly defined and scaled proportionally to the building. The entrances to each of these buildings is not articulated in a defined and scaled manner. Especially along the roads, a connection to the public way is key to making the project emulate a more urban feel rather than that of a suburban development. The 24 plex structures along Arnold and the Lantern do not accomplish this. Advisory Comments: • Ensure that electronic plans are rotated in the appropriate direction and that the drawings are flattened. Response: Electronic plans have been rotated to show as landscaped and flattened. • Adjust the road name off site from Enterprise to Discovery. Response: The road name has been corrected. Engineering Division 1. The shared use path on the east side of the project will need to connect back into the sidewalk on the north side of the project within the ROW. Response: The layout has been revised to connect the shared use pathway, on the east side, back into the street sidewalk. 2. Per the Design Standards and Specifications Policy Section V.D.3.a, sewer mains need to be located at least two feet from the edge of concrete gutters at all locations on curvilinear streets. Modify the manhole locations on the northwest section of Arnold to meet this requirement. Concept Review Comment Narrative Nexus Point Page 2 of 6 Response: The sanitary sewer alignment has been modified to comply with the City's standards. 3. The fire truck turnaround north of the proposed 1.2 acre public park needs to be a 120 foot long hammerhead. Response: The fire truck turnaround north has been revised to comply with the 120' long hammerhead requirement. 4. Any Master Site Phasing Plan will need to describe how residents maintain access to amenities and how construction traffic during construction. Response: A Master Phasing Plan is included is this submittal. As shown, the future phases of the project do not interfere with the initial phasing of the project. 5. The applicant must contact the City of Bozeman Engineering Department (Brian Heaston) for an analysis of cash-in-lieu of water rights. The transfer of water rights or the payment of cash-in-lieu of water rights shall be provided in accordance to Bozeman Municipal Code (BMC) section 38.410.130, prior to site plan approval. Response: A proposed CIL of Water Rights has been submitted to Brian H for review. No previous development or subdivision of land has occurred on this property under the City of Bozeman jurisdiction. Therefor no previous CIL of water rights has been paid. The proposed CIL of Water Rights summary is included in this application. 6. The Montana Department of Fish, Wildlife & Parks, SCS, Montana Department of Environmental Quality and Army Corps of Engineers shall be contacted regarding the proposed project and any required permits (i.e., 310, 404, Turbidity exemption, etc.) shall be obtained prior to final Site Plan approval. Response: The applicant acknowledges this condition. The government agencies that require permitting have bene contacted and or permits submitted for review. 7, An estimate of peak-hour sanitary sewer demand from the proposed project must be provided with the Site Plan submittal. Engineering can verify whether there is capacity after a sewer demand is provided. Contact Anna Russell when this information is available. Response: Included in this submittal is an estimated peak-hour sanitary sewer demand from the proposed overall project. 8. The applicant must prepare and submit a traffic impact study (TIS) with the Site Plan application submittal. The study will need to consider when a traffic signal will be warranted at the intersection of Arnold and 19th Ave. Concept Review Comment Narrative Nexus Point Page 3 of 6 Response: A Traffic Impact Study is included in this submittal. 9 The applicant is advised to contact the City Floodplain Coordinator (Brian Heaston) to review floodplain requirements including permitting for the proposed Arnold Street crossing of the adjacent stream, and flood hazard study requirements. Response: Per the FEMA Maps no flood plain is shown on the proposed lot. 10. The Engineer has not provided sufficient information regarding onsite post-construction stormwater Best Management Practices (BMPs). The Stormwater Division encourages the Engineer to review the Montana Post-Construction Storm Water BMP Design Guidance Manual (Manual) available at www.bozeman.net/stormwater. The Manual provides detailed information regarding innovative, space saving, and aesthetically pleasing industry standard practices capable of meeting the City's stormwater runoff and treatment requirements, including bioretention, permeable pavement/pavers, extended detention, and infiltration basins. Response: Included in this submittal is a proposed SWPPP. 11 If not already filed for the subject site, the applicant must provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special Improvement Districts (SID's) for the following: a. Street improvements to Stucky Road including paving, curb/gutter, sidewalk, and storm drainage b. Street improvements to South 19th Avenue including paving, curb/gutter, sidewalk, and storm drainage C. Street improvements to Graf Street including paving, curb/gutter, sidewalk, and storm drainage d. Intersection improvements to Stucky Road and South 19th Avenue e. Intersection improvements to Graf Street and South 19th Avenue I. The document filed must specify that in the event an SID is not utilized for the completion of these improvements, the developer agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property, traffic contribution from the development, or a combination thereof. The applicant must provide a copy of the filed SID waiver prior to site plan approval. Response: Included in this submittal is a Draft Waivers of Right to Protest Creation of Special Improvement Districts for the improvements listed, for City Review.
