HomeMy WebLinkAbout20096 and 20099 Notice NOTICE OF PUBLIC HEARING FOR TWO APPEALS OF AN ADMINISTRATIVE PROJECT DECISION This application is evaluated against the Administrative Project Decision Appeals criteria of section 38.250.030 of the municipal code and associated standards. Subject to protocols established pursuant to the Declaration of Emergency (see below), the public may comment orally at the public hearing or in writing at or prior to the public hearing regarding compliance of this application with the required criteria. Comments should identify the specific criteria of concern Project Name: Armory Hotel Modification Appeals Appeal Applications: 20-096 and 20-099 Summary: Two appeals of the Administrative Project Decision for the Armory Hotel Modifications to Approved Site Plan, Application 19410, have been submitted: 1. Appeal number 20-096 by The Etha Hotel, LLC: This appeal seeks to overturn “that portion of the Decision imposing upon Appellant the following condition of approval: Applicant must submit a new plan to cover EIFS exterior building materials so that no more than 25% of the entire exposed building façade (calculated by combining the exterior surface area of the Tower and the Armory, including windows) is EIFS, in compliance with 38.530.060.C.3.a BMC (2020). Some leeway on the strict percentage limitation will be considered. The Applicant’s plan to cover portions of EIFS on the exterior of the building will be subject to a 15 day public comment period, after which the Director of the Community Development Division must issue a decision on the new plan to cover exterior EIFS material. 2. Appeal number 20-099 by 5 West Residential LLC d/b/a HBP Residential Condominiums: This appeal seeks to overturn two provisions of the Director’s decision. a. Rooftop Mechanical equipment. Appellant requests the City Commission overturn the decision regarding relocating the mechanical equipment to the second and third story Armory building rooftop, which were approved in the original site plan application to be located on the top of the tower. Additionally, appellant seeks to overturn the Director’s decision regarding screening of the mechanical equipment. b. Lighting. The appeal seeks to overturn the Director’s conditions of approval to allow light fixtures L18, L19, L6, L21 and L28. Noticing: Public Comment Period 3/19/20-4/6/20 Newspaper Legal Ad 3/22/20 and 3/29/20 Site Post 3/19/20 Adjacent Owners Mailed 3/19/20 Advisory Boards: Board NA Meeting Date(s) NA Decision: Authority and Decision The City Commission will decide both appeals and in doing so may act in its authority as a board of adjustments pursuant to Resolution 4419. The City Commission will issue a decision on both appeals Monday, April 6, 2020 in the Commission Meeting Room in Bozeman City Hall, 121 North Rouse Avenue, Bozeman, MT at 6:00 p.m. along with facts in support of the comment. During the notice period the City will continue review for compliance with applicable regulations. Due to the Declaration of Emergency issued by the City on March 16, 2020, the City will be working to establish procedures to allow for remote participation in this appeal. At this time those procedures have not been established. The City will publish procedures for this appeal on its website as soon as they are available.
