Copies of the Final Plan have been forwarded to the Building Division. As the applicant,you must comply with all provisions of the Bozeman Municipal Code, which are applicable to this project. All unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not,in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. Future Impact Fees-Building permit applications will require payment of the required transportation,water,sewer and fire impact fees according to the City of Bozeman adopted impact fee schedule in place at the time of building permit issuance. If you desire an estimate of the required impact fees according to current rates please contact the Department of Community Development. Please be informed that ANY changes from the final plan or final building elevations will need to be reviewed by the Department of Community Development.This Director of Community Development project decision may be appealed filing a notice of appeal with the Clerk of the Commission for the City of Bozeman,within ten working days after the date of approval as evidenced by the Director's signature,by following the procedures of Section 38.35.030, BMC. Please be aware that as the applicant you must comply with all provisions of Chapter 38 of the Bozeman Municipal Code that are applicable to this project, including but not limited to the following: Code Provisions 1. Per Section 38.01.080&38.34.110,the proposed project shall be completed as approved and in this application. Any modifications to the submitted and approved application materials shall invalidate the project's legitimacy,unless the applicant submits the proposed modifications for review and approval by the Department of Community Development prior to undertaking said modifications. The only exception to this law is repair. 2. Bozeman Municipal Code (BMC) Section 38.24.060.B.4 states: All arterial and collector streets and intersections with arterial and collector streets shall operate at a minimum level of service "C" unless specifically exempted by this subsection. Level of service (LOS) values shall be determined by using the methods defined by the most recent edition of the Highway Capacity Manual.A development shall be approved only if the LOS requirements are met in the design year, which shall be a minimum of 15 years following the development application review or construction of mitigation measures if mitigation measures are required to maintain LOS. Intersections shall have a minimum acceptable LOS of "C" for the intersection as a whole. • The intersection of Manley and Griffin currently operates at a LOS less than "'C."The applicant requested a waiver of the intersection LOS requirement per BMC 38.24.060.4.b;however, the applicant did not demonstrate all requirements for the waiver per the referenced code Bozeman, MT 59771-12 TDD: 406-582-2301 THE MOST LIVABLE PLACE. The requested LOS waiver shall not be approved until all elements ofBMCSection 38.24.060.4.b are addressed. • The City will not issue any building permits for the project until the intersection of Griffin Drive and Manley Road is upgraded to meet the required level of service "C, a waiver is granted pursuant to Section 38.24.060.B.4 of the Bozeman Municipal Code, or another alternative mitigation measure is approved by the City to satisfy this code provision. You have the right to appeal this decision of the Community Development Director pursuant to the provisions of Article 38.35 of the Bozeman Municipal Code. Please note that this decision is also subject to appeal by other aggrieved parties as defined by Sec. 38.42.080 of the Bozeman Municipal Code. Such appeals must be filed pursuant to the provisions of Sec. 38.35.030 of the Bozeman Municipal Code. An appeal must be filed within 10 working days following the date of this decision. If a valid appeal is filed, no further action on the project may proceed until a decision on the appeal is made by the City Commission, and the Community Development Department and Building Division will not be able to approve any building permits or to perform any inspections related to this application.
