HomeMy WebLinkAboutDOAR letter 1-31-2020 BOZE MAN MT City Management January 31, 2020 HAND DELIVERED ONLY Gallatin County Attention: Jim Doar County Administrator 1709 West College, Ste 200 Bozeman, Montana 59715 Re: Update to my letter of January 17, 2020 Regarding Invoice for Street Improvements to Oak Street and Ferguson Avenue and Notice of Default - Baxter Meadows Annexation Agreement Dear Mr. Doar: On January 17, 2020 I wrote to you requesting Gallatin County respond to the City's demand for payment for improvements to Oak Street and Ferguson Avenue. Today the City filed its answer to Gallatin County's complaint. In addition, the City filed counterclaims as mentioned in my January 171h letter. The County continues to have until February 18, 2020 to cure its breach. As noted in my previous letter, if the County makes arrangements to do so and dismisses its lawsuit the City is prepared to do the same. If the County makes assurances by February 18, 2020 the City will waive the incidental costs of $1,000.00 associated with SID 745. We continue to be hopeful Gallatin County will reevaluate its position and come to the table in a meaningful way to participate in the funding of this critical infrastructure. Sincerely, Dennis M.
