Box 1230 Bozeman, MT 59771-1230 Re: Site M – The Aviator Building Site Plan Application Resubmittal after Denial MMI#: 3638.009 Dear Mr. Krueger: The following Site Plan application is for the development of the Aviator Building to be located on Lot 16A in Block 3 of Phase 2 of The Bozeman Gateway. The property includes 0.45 acres all zoned B-2. The building will be a mixed-use building with proposed uses of Restaurant, Retail and Office. Outdoor patio areas will be used as outdoor and public seating areas. The building will be 3 floors not including basement, have an approximate gross floor area of 36,451 SF and will provide 170 parking spaces. The parking will be provided by the existing parking lots to the east (CA 3A) and west (CA 4A) of the proposed building. Parking will also be provided to the south of the building in (CA 7) and (CA 8). The remainder of CA 7 and a portion of CA 8 will be constructed with the Aviator Building. The site will not have any materials adverse effect upon the abutting property. The site does not have any special requirements to protect the public health, safety and general welfare. This project went through the City of Bozeman’s concept review process in October of 2018 and site plan application with denial on July 18 th , 2019. Attached is two 11x17 copies and two digital copies of the Aviator Building Site Plan Application. SITE PLAN CHECKLIST SP1 FORM – Items Not Applicable GENERAL INFORMATION 8. d. There is no residential component with this application SITE PLAN DETAILS 17. The City limit boundary and Gallatin County’s Bozeman Area Zoning Jurisdiction is greater than 200’ from the project 28. (a, b, c, d) There are no ponds, streams, irrigation ditches, watercourse, water bodies, wetlands, or floodplains located on this parcel. 31. There are no significant rock outcroppings. 36. Spoils storage is not proposed. Excess material will be hauled off the site during construction. 40. Box 1230 Bozeman, MT 59771-1230 Re: Bozeman Gateway Site Plan Review – Aviator Building COB#: 19517 MMI#: 3638.009 Dear Sarah: This letter is to provide written responses to the comments stated in the DRC review memo dated January 22, 2019. Below are our responses associated with each comment. Section 2 – RECOMMENDED CONDITIONS OF APPROVAL Please note that these conditions are in addition to any required code provisions identified in this report. These conditions are specific to the development. 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. 2. The site plan shall have an initial entitlement period of one year. The applicant may seek an extension of not more than one additional year. Extensions may be sought under the provisions of Section 38.230.140. Planning Division, Sarah Rosenberg, srosenberg@bozeman.net, 406-582-2297 1. The parking lot that is part of Phase 4 needs to be removed from all the site plans. The parking lot part of Phase 4 has been removed from view in all the site plans 2. To comply with the PUD and since this would be the final building to be built in Phase 3, the entire parking lot should be constructed. This includes Common Area 8. Acknowledged 3. Photometric Plan. Per Section 38.570.040.G and the Bozeman Gateway PUD Design Manual, many of the light fixtures do not meet this standard. Please review the Exterior Façade Lighting section in the Development Manual and the BMC section on lighting. a. Parking lot lighting may not exceed .2 fc. Table 38.570.040-1 States that the Minimum footcandle level is 0.2 fc. The design meets this requirement See PH201. The parking lots are designed to be consistent with the existing portions of the development utilizing the PUD approved luminaire. b. Building entrances must be an average of 5 fc. Include average on elevations and by entrances on site plan. Typically, we anticipate 5fc to be measured on the ground although elevation averages are shown per request. See averages on PH203, PH301 and PH302. c. E10 is not an allowable light fixture as it is not full cut off. 38.570.060.A.3 states “ For lighting horizontal areas such as roadways, sidewalks, entrances and parking areas, fixtures must meet IESNA "full-cutoff" criteria (no light output emitted above 90 degrees at any lateral angle around the fixture).” Type E10 is not illuminating surfaces such as roadways, sidewalks or entrances and therefore is requirements does not apply to Type E10. 38.570.060.A.2 states “ All outdoor lighting fixtures must be shielded in such a manner that no light is emitted above a horizontal plane passing through the lowest point of the light emitting element, so that direct light emitted above the horizontal plane is eliminated.” Type E10 is mounted to the underside of a 2ft overhang (See E10 Window Section detail and E10 Window Plan View on sheet PH103). The overhang structure itself serves as a shield to block light above the horizontal plane into the sky. 38.570-060.A.2 states “ Fixtures must be of a type and design appropriate to the lighting application.” Type E10 is intended to lighting the perimeter of the window well (not the window itself). This luminaire is suited for the application as it provides a clean, narrow line of light to complement the architectural aesthetic of the building. Refer to on the sample application images on page PH103. Providing this luminaire in the window recesses, highlights elements to accommodate the Development Manual Façade Lighting item that states, “Entrances and projecting elements should be highlighted to create a visually lively street at night.” As part of the building design, Type E10 luminaires will be equipped with dimming capabilities and controlled separate from other exterior lighting types. This will allow for illumination reduction and on/off control independent of the other exterior lighting. d. Type E9 does not have an image of what the light looks like therefore we cannot tell if it is full cutoff. See additional image on PH102. Type E9 is the PUD approved wall light and is specified as downlight only. The approved Bozeman Gateway Design manual encourages all buildings to incorporate this luminaire. e. Provide more details on E3. It appears it does not meet full cut off. Type E3 is a recessed mounted in the side of the wall and steps to provide low level illumination for pedestrian safety. This step light is louvered to reduce glare and direct light towards the ground. See enlarged images on PH102. f. Identify what handrails E11 is proposed to be located. See notations on PH202, PH301 and PH302. For additional imagery, refer to architectural east elevation E3.1 for second level patio handrail location; south elevation on A3.2 for second level patio handrail location and north elevation A3.1 for main level patio handrail. 3D images on pages G2.1-G2.4 also show handrails in the various isometric views. Engineering Division, Anna Russell, Engineer II, arussell@bozeman.net , 406-582-2281 1. BMC 38.220.080.A.2.l Site Plan Submittal Requirements. Provide a construction staging plan including equipment and worker parking, concrete washout, material storage, construction trailer, and trash receptacles during construction. The construction staging items have been added to sheet C410 Erosion & Sediment Control Plan 2. Fire service plans, and domestic services 4” or larger, must be a standalone submittal, separate from the Site Plan submittal. City of Bozeman applications for service must be completed by the applicant. Separate Fire service plans have been digitally submitted to Anna Russell on 1/27/2020, hard copies will be submitted to the city once the plans have been approved. Forestry Division; Alex Nordquest, anordquest@bozeman.net, 406-582-3205 1. The landscape plan calls for one honeylocust at the northeast corner of the property. Due to the adjacent overhead electric, they need to swap to a smaller-sized species. Approved trees for planting near utilities are marked in the Street Tree Guide with a “U”. The honeylocust in the northeast corner has been changed to Ivory Silk Japanese Lilac Tree. 2. Street Tree Guide - https://www.bozeman.net/home/showdocument?id=988 The street tree guide has been used to select the appropriate tree. NorthWestern Energy; Cammy Dooley, cammy.dooley@northwestern.com 1. Clarify gas meter location. They will need to provide enough wall space for all the meters. These can be stacked but it will be limited to 2 meters high. Please plan a minimum of 1’ length for each meter, plus an additional foot for the regulator. If they want to stack the meters, that will be around 5’ in height. In addition to those lengths they will need to provide a minimum of 3’ from the regulator to the nearest electric meter. A utility location plan and elevation exhibit has been supplied in the resubmittal, see sheet A1.3. 2. Please also contact Dylan Swanson at Dylan.swanson@northwestern.com for an easement across the open space. Dylan has been emailed a copy of the easement exhibit for the NWE line across the open space on 1/27/2020. Solid Waste Division; Kevin Handelin, khandelin@bozeman.net, 406-582-3238 1. Location of refuse enclosure is fine, however, make sure the curbs do not wrap around in front of the closures. It appears that trucks may run over curb on left hand side of enclosure. The curbing has been modified to ensure easy access for garbage trucks to the enclosure. 2. Enclosure doors must open 180 degrees.
