SUBJECT: Resolution 4741 Creating a Payback District for the 2016 Bridger Drive
Trunk Sewer Main.

RECOMMENDATION: Approve Resolution 4741 Creating a Payback District for the 2016
Bridger Drive Trunk Sewer Main.
BACKGROUND: The Bridger Drive Trunk Sewer Main project not only included the master
planned main along Bridger Drive, but also a local 8” main on Story Mill Road and Griffin
Drive. The 8” main provides service through a direct connection to all of the properties along
those two streets. Of the ten tracts included within the district (shown on the attached map),
eight are owned by two parties. Those two owners paid for the construction of all of the 8” main
and appurtenances described above. This district, if established, will provide a means for
reimbursement by the owners of the tracts that did not participate in initial construction costs.
The payback is due at the time of connection and the costs are based on a square footage
assessment.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: The City retains a 7% administrative fee for processing all paybacks.

COMMISSION RESOLUTION NO. 4741
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING A PAYBACK DISTRICT FOR THE BRIDGER DRIVE TRUNK
SEWER MAIN.
WHEREAS, the City did design, bid, and contract for the construction of the City of
Bozeman 2016 Bridger Drive Trunk Sewer Main project; and
WHEREAS, property owners Wake UP, Inc. and 2511 N LLC paid for the construction of
a portion of the project in an amount of $167,868.13; and
WHEREAS, other properties will benefit from the improvements paid for by Wake UP
and 2511 N but have not contributed to the cost of the improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that a payback district be created for the Bridger Drive Trunk Sewer Main, as
contained in the Agreement for Reimbursement, attached hereto, be and the same are hereby
approved; and the City Manager is hereby authorized and directed to execute the Agreement for
Reimbursement for and on behalf of the City; and the City Clerk is authorized and directed to attest
such signature.
