RESOLUTION NO. 15320-2D
RESOLUTION OF THE CITY OF BOZEMAN PLANNING BOARD REGARDING AN
AMENDMENTS TO SECTIONS 38.26.070 AND 38.41.080 OF THE MUNICIPAL CODE
REGARDING THE PROVISION, USE, AND DISPOSAL OF WATER IN LAND
DEVELOPMENT.
WHEREAS, the City of Bozeman has adopted a growth policy pursuant to Section 76-1-
601, Mont. Code Ann.; and
WHEREAS, the City of Bozeman Planning Board has been created by ordinance by the
Bozeman City Commission as provided for in Title 76-1-101, Mont. Code Ann.; and
WHEREAS, the City of Bozeman has adopted various provisions providing for the
protection of the public health, safety, and welfare including the requirement for City review
procedures to evaluate water adequacy with the subdivision of land or other site development in
order to protect the community's collective water supply needs; and
WHEREAS, the intent of the proposed text amendment is to undertake a set of changes
that are independent from but associated with recently accomplished and also separate
forthcoming text amendments related to subdivisions, parkland, water adequacy, and
conservation efforts concerning irrigation, consumption, and management; and
WHEREAS, the intent of the proposed text amendment is to clarify text language, guide
efficient resource management for landscaping and irrigation in City parks and rights-of-way,
facilitate the plan review process by ensuring provision of specific water sourcing and easement
information, and increase code consistency to City growth policy and adopted plans concerning
water; and
WHEREAS, the City of Bozeman requires review of landscaping plans and irrigation
systems, and authorization of water adequacy prior to development approval; and
WHEREAS, the proposed text amendment application has been properly submitted,
reviewed, and advertised in accordance with the required procedures; and
WHEREAS, the City of Bozeman Planning Board held a joint public hearing on
Tuesday, November 15, 2016, with the City of Bozeman Zoning Commission to review the
application and any written public testimony on the application; and
WHEREAS, no members of the public provided written or oral testimony on the matter
of the text amendment application; and
WHEREAS, the Department of Community Development, based on the materials and
information provided by the Applicant and analysis of the proposal included in the Staff Report,
recommended approval of the requested text amendments; and

WHEREAS, the City of Bozeman Zoning Commission reviewed the application against
the purposes of the zoning enabling act; and
WHEREAS, the City of Bozeman Planning Board reviewed the application against the
purposes of the subdivision and platting act; and
WHEREAS, the City of Bozeman Planning Board voted 5:0 and the City of Bozeman
Zoning Commission voted 4:0 to forward a recommendation of approval to the City Commission
for the text amendments;
NOW, THEREFORE, BE IT RESOLVED, having heard and considered public
comment, application materials, and staff findings the City of Bozeman Planning Board voted
5:0 to officially recommend to the Bozeman City Commission approval of text amendment
Application 15320-2D to amend Articles 38.26.070 and 38.41.080 of the Bozeman Municipal
Code to update provisions for irrigation systems in City parks and rights-of-way, support
development plan review of irrigation systems and water sourcing, and clarify text language.
