ORDINANCE NO. 1080
AN ORDINANCE OF THE CITY CO~1MISSION OF THE CITY OF
BOZEMAN, MONTANA, ESTABLISHING RATES FOR SEWER
CHARGES FOR THE CITY OF BOZEMAN.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1 I
That Section 10.19.020 of the Bozeman Municipal Code be, and the same is hereby
amended to read as follows:
10.19.020 Sanitary Sewaqe Disposal. (1) Until otherwise prescribed in accordance
with the covenants and provisions of the ordinance codified in this chapter andQhapt~rs 10.16
and 10.18, there shall be imposed a sewerage charge upon each user of the sewerage utflity,
which shall be due and payable monthly, in advance, commencing November 1, 1981, to be as
foll ows;
(a) Unmetered Customers $6.80 per month
Monthly Charge for All
Metered Customers $2.90 per customer per month
Additional Charges for Metered Customers
Residential $0.48/ccf based on total average water usage
during the months of Nov., Dec., Jan., and Feb.
Commercial, Industrial
and M.S.U. $0.48/ccf based on total annual metered usage.
Charge for Extra Strength Waste
Suspended Solids in
Excess of 200/ppm $0. 115/pound
Biochemical Oxygen Demand I
in Excess of 250/ppm $0.095/pound
(b) Charges for sewer rental under this schedule shall be made a part of the current
monthly bill for water used, to be shown by separate item or surcharge on such
bill. Acceptance will not be made of separate payment of either the charge for
water or the charge for sewer rental. Both charges must be paid at one and the
same time.
(c) Charges for water used and for sewer rentals become due and payable on the first
day of each month. I f any bi 1 'I is not pa i d on or before the fi fteenth day of
that month, it will then become delinquent and if not paid in full by the fifteenth
of the following month, water service to the premises involved shall be discontinued.
A charge of one dollar will be made for reinstating a water service which has been
discontinued for nonpayment of water and sewer rental charges.
(2) In cases where sewer rentals under this schedule are claimed to be unfair,
unreasonable, or not in proportion to charges made to other water and sewer
users, the person or persons against whom such charges are made may apply
to the City Manager or the City Commission for an adjustment, stating the
circumstances, and the City Manager or the City Commission may make such
adjustment of such sewer rental rate as ;s deemed necessary, fair and
equitabl e.
(3) In the event that it becomes necessary or desirable at any time to change
the schedule of sewer rates, charges and rentals hereinbefore set forth,
and such changes are duly and regularly made by the City Commission of the
City of Bozeman, such changed rates, charges and rentals shall be and remain
effective without repealing or amending the ordinance codified in this
chapter and Chapters 10.16 and 10.18 in whole or in part, providing that
certified copies of such changed rates, charges and rentals shall be and
remain on file for publ ic inspection at the office of the City Clerk of the I
City of Bozeman. (Ord. 947 Sec. 3 (part), 1974).
Section 2 .
This Ordinance shall be in full force and effect from and after thirty (30)
days after its adoption.
